Hey Fellow VJ's,

My husbsnd received his emoloyment/travel card but it's only valid for one year.(Normal?) Is it expected for him to receive his AOS approval within this year? We filed in April rcvd card in June 25... How much longer could the rest of the process takep? The AOS still shows Initial Review Status in USCIS Website. I was worried or wondering if the one year passes (employment card) and we still have no result do we have the option to extend employment or we have to apply again for the card and pay fee??? I appreciate any response to understand the process that would normally follow.

Yes it is normal for the Employment Authorization/Advance Parole to be valid for only one.

Is it expected for him to receive his AOS approval within this year? We filed in April rcvd card in June 25...

It is up in the air for K-1's. You could get an interview or you could get an interview waiver letter which basically says that it could take another six months, and that you are eligible to not have an interview. Again this is 50-50 chance. There is no specific criteria that they pick for interviews or for interview waivers, its a toss up.

How much longer could the rest of the process takep? The AOS still shows Initial Review Status in USCIS Website.

Could take anywhere from another 3-4 months to another 8-9 months, depends, again its a toss as there are many factors (whether or not you will get an interview, if you get an interview whether or not the service center is slow or not at that time)

If your AOS is still not approved 3 months before the EAD/AP expires then apply for another one and the fee is waived due to filing under Section ©(9). Looking at the instructions though it is saying that the EAD cannot be renewed. If there has been a change in the rules concerning this someone please chime in.

I appreciate any response to understand the process that would normally follow.

The green card is usually approved within that year the EAD/AP is valid. However, sometimes they take longer. The EAD is renewable, and the fee for the renewal is still waived. You just file with a copy of your receipt notice from filing the I-485. Page 8 of the I-765 instructions tells you that a renewal under the (c )(9 ) category does not require a fee.

If Your EAD has Expired

If you are still eligible for work authorization but your EAD has expired, you should file for a renewal EAD by submitting a Form I-765, Application for Employment Authorization. You cannot file for a renewal EAD more than 120 days before your original EAD expires.

The GC you will get once approved is good for 2 years. The GC gives the right to work and travel by itself, and renders the EAD obsolete.

Within the 90 days following the expiration of the Greencard, you will need to file for Removal of Conditions. Check out the instructions on form I-751.

I am more than sure Harpa meant to type within the 90 days before the expiration date on your green card is when you have to file for ROC. http://www.visajourney.com/content/751guide
