My wife had her visa interview in El Salvador on June 20th 2014 and they told her she has to file the I 601 and 212 waivers. Our lawyer mailed them and they were received on June 24th 2014. Realistically speaking how long could this process take. I'm really concerned because my kids stayed in El Salvador with her. It's frustrating because some people say it takes around 5 months but some people say it could take more than a year. Anyone know how long I should expect?

~6 - 12 months is fairly accurate. It's not an exact science when it comes to waivers.

Its taking 4-6 mths for a few ppl but some have been

waiting over 14 mths with not much complications in

their cases....just pray for the best ,hopefully the atty wrote

The fact that my younger son needs Early Intervention Therapies. My older son needs to come back to school here and due to my work schedule I cannot handle that on my own.

If the reason for her waiver was a mere overstay you should be looking at an average of 6 months. However if there are any other complications such as crime, felony, legal proceedings etc. the process should take longer depending on the charges. You just need to be patient.

I hope so. We called USCIS today to try and get our case expedited. They told us to wait about a week for the response. Hope they consider us

Got a response from uscis saying they want me to submit proof that my kids need to come back to school and that my younger son needs therapies. My lawyer says he will send them hopefully Monday.
