Question regarding I-751 and I-360

I am trying to get a couple answers here without revealing too much information.

Can a USC find out if their spouse has filed for a I-751 waiver or I-360 documents? They are currently in the 90 window on when they need to file and I wanted to check. If USC can't just call and find out then can I make an Infopass appointment and try that way?

I may write more as to why later but I am sure some of you may know why I ask this.

Only the beneficiary can tell you, if he/she options to. There are strong privacy laws in place, precisely because of abusive situations.

I don't know why you want to know this, but let's all continue with our lives, shall we?

First if you were even going to contact USCIS you would need to know what youre talking about- which you dont based on the phrasing above. The 360 is a form for people who dont have a GC at all and like mentioned can be filed any time during the marriage and in the 2 year 'window' after divorce.

The 751 is the removal of conditions form, that does have a 90 day window but they can be accepted late with explanation and still be okay. Your stating the 751 would be with a waiver and again like above it doesnt matter if it was a divorce waiver or an abuse waiver box that was ticked- its a matter of privacy.

They will not disclose or share with you someone elses file just because you ask. Not the contents, not the status, not a peek, not a hint of whats going on. Doesnt matter your relationship- past or present. I know in some cases if the immigrant gives you explicit permission like they are on the phone with USCIS and due to poor English will be like here talk to my spouse I dont understand you, USCIS will bend the law slightly and say oh so 'spouse' is acting as a 'translator?' If immigrant says yes and gives consent then they will speak to spouse. (But with things that get adjudicated through Vermont- abuse- there is no phone option) Other then that you are looking at a court order to obtain info from USCIS unless you are the person. Heck even when you are the person you know what kind of forms you have to fill out to get stuff back or hoops you jump through to find out case status??

So the easiest way to tell if someone (your ex) has filed forms like the 751 with a waiver is .... dun dun dun- if you see them still in the country working, living like normal,with no interruption in their lives, then yup they applied. If after a few months they dont leave, they were probably approved for the 10 yr card. IF you dont see them around the 90 day window and you hear rumors they left- they probably did rather then be denied and have a hard time getting another visa in the future.

But the healthiest thing to do (and Im not sure if this applies to you because your username sounds familiar but I dont remember your story sorry) but the healthiest thing to do is to say they are my ex and they are my ex for a reason and to leave them in the past. Stop caring if they get a 10yr or if they dont. Let them be someone elses headache. They are just baggage to you and like in the airport its easier to move through life with the least amount of baggage as possible.
