Hi everyone,


I posted these questions a couple weeks ago and got no replies for any of them. I would really appreciate some help! We got married a week ago and are trying to do the adjustment of status



1) For the I-864, what type of proof of income do we need to send in if any? I just started my job (I was a graduate student last year) so my 2013 taxes don't reflect my current income. We had my dad co-sponsor for the Visa. Should he co-sponsor for this too?



2) I'm a little confused on who the Cover letter should be from/signed by. Visa Journey's guide says the "petitioner" For an adjustment of status does that mean the US citizen? Or does that mean the Immigrant?



3) He had his medical exam overseas before his interview. Do we need to submit proof of that or do they have record of that?



4) His birth certificate is in Spanish, do we really need to translate it? If so does it need to be notarized or something?



5) he just went in and applied for his SS card yesterday and they said it would take 2 weeks to come. Do we need to wait for this before we turn in the adjustment of status docs so that we can put the # on the forms?

If you just started the job, then yes, you may want to ask your father if he is willing to be the joint sponsor and provide an I-864, though you could always try first on your own without sending in joint sponsor documents. They would send an RFE for one if they did not feel you met the requirements. You need the I-864, most recent tax transcript and proof of current income which is a letter from employer and/or recent pay stubs. If you use a joint sponsor, they also need to provide the same plus proof of being a USC or LPR.

The foreign spouse is the AOS applicant. The forms are all theirs, with the exception of the I-864. Just the AOS applicant or both of you could sign the cover letter. Doesn't matter that much.

Yes. Any document not in English must have an English translation with it. It can be anyone fluent in both languages. Notarization not needed, but whoever does the translating needs to provide this certification on the translated document > http://www.visajourney.com/content/translations

SSN not needed to apply for AOS.

3. i thought you needed a USCIS-approved civil surgeon for the AOS?

no idea about 4 and 5, sorry! ok i do know that you do need to translate all documents that are not in english, but i don't know about getting it notarized.

2,) Your cover letter includes a lot more than someone adjusting from a K-1 needs to include. It could still be a bit helpful, but might confuse some people into thinking they need to send an I-130, other unnecessary forms and proof of marriage(other than marriage certificate) when adjusting from a K-1.

3) This is the forum for adjusting from family based visas such as the K-1 and the OP is adjusting from a K-1. A K-1 is not required to receive another medical exam if their K-1 medical abroad was done within a year of filing for AOS.
