hi guys, as our k1 visa process is hopefully finally moving forward, i am starting to think about the interview and what all i need for it. i know that i need a police ceritificate from my country of birth, and i've also asked this question somebody before but i really want to make sure and know 100% that i am doing the right thing. I have "lived" in the US for two school years (with vacation break) as an exchange student (j and f student visas), 10 months at a time, with a host family, and attended the local high school, does this count as "residency"? Do i need a police ceritificate from the US? I just need to be sure, thanks!

I had same question you had when I was preparing for the interview. What I found as the answer was.... you don't need to worry about getting police certificate from the US. I have lived in the US over 10 years and even before that, I had visited the US so many times and spent few months for vacation. You do not need to even worry about it !!!! :dancing::dancing::dancing::dancing::dance::dance: Be happy!!!!!! =) You need to have police certificate from the country you are currently in. and If You have lived any other counties over a year after you turned to age of 16(?), you would need to get PC from those countries as well.

I lived in NZ for about 10 months, so I didn't need PC from NZ. :dance::dance::dance:

I had same question you had when I was preparing for the interview. What I found as the answer was.... you don't need to worry about getting police certificate from the US. I have lived in the US over 10 years and even before that, I had visited the US so many times and spent few months for vacation. You do not need to even worry about it !!!! :dancing::dancing::dancing::dancing::dance::dance: Be happy!!!!!! =) You need to have police certificate from the country you are currently in. and If You have lived any other counties over a year after you turned to age of 16(?), you would need to get PC from those countries as well.

I lived in NZ for about 10 months, so I didn't need PC from NZ. :dance::dance::dance:

Are you sure on this?

My (Chinese) fiancee studied in Russia for 5 years, and when we called the Guangzou embassy,

they said the Russian police certificate was absolutely required, and we had to delay the

interview scheduling because of that.

The way I read it is, you have to provide police certificate from all countries that you resided more than 6 months

so that they can see if there was any criminal activity...

I could be wrong...but this is how it was explained to us by US embassy in China.

Your fiance spent over a year in Russia. Yes! she or he does need police certificate. You have to provide police certificate from all countries that you resided more than 12 months not 6 months since you turned to age of 16.

No, a resident is not necessarily a US citizen. A resident means you resided in the US legally. Someone with a green card is a legal permanent resident. In your case you resided here legally on student visas. It is basically saying if you resided in the US at anytime, past or present, you do not need a police certificate from the US. You just need them from anywhere else you resided for 6 months or more since the age of 16.

ah dang this is extremely confusing.....i also dont know cuz i mean being on a student visa is just that, how would that fall under the category of residency....but then again, i stayed 10 months at a time as an exchange student....if it takes 5 months im screwed. yeah ill call the nvc

Like I've said, if its required, they will ask for it during the interview,

so the safe way to play it is to go file for one ASAP and get that started

unless you can positively confirm that it's not needed.

This way you have some back up option.

I had f-1 visa in the US for over 9 years. I was legally staying in the US as an international student. During the process of getting NOA1 and NOA2, they check applicant's and beneficiary's criminal records in the US. Do not need to even worry about it. Just make sure that you have PC from other countries where you lived longer than a year since you were 16. I came to Korea last year and I didn't spend a year here but I needed it.

i hope ur right but im still confused. isnt student visa for only as many years as university is...

and ive read somewhere that you only need to translate into english if its already not in english or if its in anothr language that the country's language...

Well.. I was so confused like you. I was in your shoes. I had to keep my f-1 visa valid and had to transfer from this school to that school haha.... I had 2 BS degrees. US does allows you to stay as F-1 as long as you pay the tuition on time.

If anything is in English, you DO NOT NEED to translate it ....of course.. =)

CALL USCIS OR NVC IF YOU STILL FEEL UNSURE ABOUT IT

BUT I SPENT SO MANY DAYS TO FIND OUT THIS INFO.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

07-11-2022: Naturalization Interview

Everything that is submitted at the interview eventually gets given back to you or placed the brown/yellow "do not open" envelope to bring back to the U.S. at your POE, which is then brought back to USCIS awaiting the time you apply for AOS. All foreign language documents must be translated which includes Birth Certificates, Police certificates, etc.

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-10-2022: Interview letter received via USPS.

Everything that is submitted at the interview eventually gets given back to you or placed the brown/yellow "do not open" envelope to bring back to the U.S. at your POE, which is then brought back to USCIS awaiting the time you apply for AOS. All foreign language documents must be translated which includes Birth Certificates, Police certificates, etc.

Yes, you must translate it all before the interview, they won't accept any formal documents that have not been translated.

Everything needs to be translated into English unless your country uses English as mother lan.... :) hope i was being helpful. I know how stressful it is. You will be fine! :)
