NVC sucks!!!! Can I leave everything and come back?

Oh my Goodness!!!!!! THIS PROCESS!! I hope it goes fast for you. I have a close friend waiting at NVC stage right now , and I pray for comfort for everyone during these extremely trying times. We have had our K-1 petition sent back so I am trying to get to my fiance to finally just get married and start a new process maybe... oh man !! THIS IS SO CRAZY! Hang in there!!!!! I would say if you have made enough income already this year to cover the amount needed for sponsorship, and you have the resources to go over there, I would go!! Or find a co-sponsor! The CO can review the new paperwork if necessary. Sometimes mental health decisions are the best ones to make. God be with you.

I would agree with Dohan too - Please don't give up now- did you get an RFE for AOS? Did not realize that Delhi embassy is so packed!

Yes if you there at visa interview it helps. My cousin went for interview at bombay and agent ask her about something weird and she said my husband is sitting outside (visiting from USA) can I get him to answer your question. No question asked after that. He just stamped the visa.

Thanks for all your support, everyone. I will be able to make enough for 2014 by October. I think I may leave to be with my wife then. We can both go for the interview and I can come back and find another job. As Sara above pointed out, its a mental health decision at this point.

Can someone point out what the consular officer will ask that will need me to provide a new AOS? I sent my AOS 2 weeks ago and so far no checklist. I want to be prepared for any eventuality. If my income for this year by October is above the poverty line, do I have to submit another AOS during the interview? How does that work? Can i just keep my mouth shut and not talk about it during the interview?

No, you cannot be coy as that amounts to Material Misrepresentation, if the circumstances on your I-864 change from the time it is submitted to the NVC to the time of the interview, then you will have to submit a new I-864 at interview time. Also, it will be highly unlikely that you will see a CO since it's your spouse they would be interviewing.

So I can submit a new I-864 at interview time? I dont have a problem submitting an I-864. I have a problem with the delays. What are the possible outcomes when I or my wife submit a new I-864 at interview time? Does the CO look at it and take a few months? Do they just accept it and give us the visa? And I understand the process is subjective but if I had a list of possible outcomes, I can weigh the pros and cons of my decision.

I intend to accompany my wife to the interview. So I will be there with her. The New Delhi consulate does allow spouses to accompany .

Circumstances change all the time, I received a pay raise between the time i submitted the I-864 to the NVC and the time my wife was interviewed so i just brought a new form to reflect this. I'll speculate that it took a CO a few minutes to look it over to ensure it was properly completed and that I met the qualification; there were no delays associated with this.

Remember, the NVC is not the decision maker on whether or not an I-864 is accepted, the CO is.

If you are no longer employed your I-864 must reflect that you no longer have a current income at interview. Unless you qualify with assets, you will need a joint sponsor. Dont play coy, dont lie, either by omission or directly not telling the truth. You are risking your spouse NEVER living in the USA by doing so.

be certain you understand the difference in

1. current annual income and

2. prior years tax data

as both are evaluated on interview day.
