NVC sucks!!!! Can I leave everything and come back?

So the NVC is taking 30 days to review DS-261. After that the IV fees will be available. THen they take another 2 months to review the IV packet. If there is a checklist then it is another 2 months. I am looking at 5 months more. I filed IR-1 last year on August 1st. I am already on the edge with work and life.

Is it just my luck that sucks? Everything is delayed beyond belief. I f****** hate it.

Can I quit my job and go back to India and do the rest of the process from there? I have submitted my AOS. I can always come back and get a job. I am fed up of everything at this point.

AOS is not final until interview. NVC simply collects paperwork and checks for correctness to make the CO's job easier. If the circustances change before interview it would misrepresentation not to reveal that at interview. If you lost your job or changed work, you need to resubmit the AOS so that it's accurate as possible at interview.

How often do they ask about financial conditions in the interview? If I stay here for another 7 months, my wife will go crazy. I had told my wife that once we get approval things would go quicker. Now it will be another 7 months if I am lucky.

This is bogus. Totally bogus. I file documents and am asked about them 7 months later in an interview. Life changes in 7 months. And then I file new documents and wait another 5 months. This is an endless cycle. I can see why people cheat the system. I filed a K1, got rejected, got married, filed an IR1, waited a year for approval. Now I have to wait another year and answer more questions. This is messed up.

7 months seems pretty extreme. Your timeline is still k1 so I have no idea where you are in the process. I fail to see how you can't take vacation or unpaid time off unless you think you're going to be fired.

Your k1 being denied obviously put a kink in your life plans.

The New Delhi embassy is packed up and takes 3 months to give an interview date. The NVC will take 4 months to clear. I have taken 4 weeks of leave this year already. I doubt any one cares for my personal problems at work if the company cannot get the job done. I feel totally helpless.

you've come along too far to give up now. As far as I know while spousal visa application is pending, your wife can come visit (if I understood correctly she is in India). So long as he ALREADY HAS a tourist visa.

Please don't give up and believe that everything will be fine. I know it's extremely frustrating but at this point in the process you are almost there. Since you're going to have the interview at New Delhi I would suggest that you both go to the interview, people have reported that it helps a lot.

on interview day, it doesn't matter where the USCitizen petitioner is.

However, the AOS/I-864 is adjudicated that day (NVC only checks for completeness) so if :

1. your 2013 income is good on a tax return and

2. your current annual income for 2014 is good

then you won't have any problems.

Do some math with a calendar, figure out what is what.

I hear ya.. I'm a Jan 2013 filer and I am STILL in the NVC process. Just don't give up... you've come so far.. I highly recommend getting a punching bag and a large fluffy pillow to scream into. Sorry I can't be of more help.. but I totally get the emotional trauma you're suffering.

6 Mar 2013 -- I130 transferred to Orlando local field office (which started the whole nightmare)

Mar 2013 to October 2013 no one would tell us where our case was or what was happening. I suspected the whole time it was just sitting in a corner somewhere in the Orlando field office. I was pretty much right.

October 2013 - get congressman involved. Congressman asks USCIS repeatedly about our case but they won't even tell them anything.

31 Jan 2014- finally get NOA2!!!! (we think the nightmare is over!)

NVC

Our case was not sent from the Orlando field office as it should have been. The nightmare continues. We kept calling NVC and asking if they received our case, and they always said "NO" and that we had to wait 90 business days for it to be received. We called USCIS during this time and they kept telling us it had been sent. After the 90 days of agonizing frustration, NVC then started telling us we had to wait 120 business days. I got our congressman involved again, and they told the congressman it was sitting at the Orlando office this whole time (just as I thought it was!).

22 Apr 2014 -- NVC received
16 May 2014 -- NVC case number assigned
24 May 2014 -- AoS and IV bills paid

28 May 2014 -- Sent AoS and IV Packages

6 June 2014 -- documents scanned

18 July 2014 -- false checklist from NVC

21 July 2014 -- Case complete

28 July 2014 -- receive case complete email from NV

30 July 2014 -- interview booked! September 11 here I come!

It is making life really hard. It has been 2.5 years. I know I should not give up but this is taking things to breaking point. My wife is all alone there with no support from her family. It really sucks big time.

Which is why you just need to be patient a bit more and then you will be together! Imagine if you just drop the process now, yes you could go to India and be with her and settle there. But probably won't be a walk in the park either.

We are all rooting for you! Keep calling NVC, contact your Senator. Do not give up on your happiness and the happiness of you wife!
