Hi everyone,

I am just starting the process of filing for adjustment of status from B2. I arrived in March to visit my boyfriend. I intended to return to Australia, but he proposed and we got married last week. I am a dual Canadian/Australian citizen and entered the US using my Canadian passport. I am wondering whether when filing the I-I85 I should include a copy of both my passports or just the Canadian one because I entered using it? I was born in Australia so my birth certificate is from there.

Your advice is greatly appreciated. :)

You may want to see an immigration lawyer or do some extensive research prior to applying for an AOS.

I too am Canadian and married my USC husband while visiting on a B2.

It was advised that I return to Canada and have my husband petition for me using an I-130 (he also filed an i-129F).

I traveled back and forth visiting while we waited for the initial petition to be approved.

We did have a change of circumstances while I was visiting the US that permitted me to file an AOS. I have my interview in the US on Aug. 8th. We initially filed the I-130 in May 2013.

Good luck to you....be diligent prior to doing anything that could make your situation worse.

Thanks for your reply. The tricky thing is I don't/have never lived in Canada I just have a passport because my dad was Canadian. Traveling back and forth to Australia isn't really an option. I've read a lot on here that adjusting if you didn't intend to marry when you arrived in the country then you are okay. If you don't mind me asking what was the change or circumstance? Good luck for your interview.

Hi Ery, I would probably attach the main pages of both passports .. along with a short note explaining my reason for this.. Good luck to you!

Really? I'm a dual citizen too but only sent my British one since I haven't used my Chilean in years. Will bring it to the interview if they ask. Where it asks country of citizenship/nationality I just inserted United Kingdom. Ugh wonder if I'm in trouble now :wacko::wacko::wacko:

07/28/14 Received NOA1 for I-485 (finally)

07/30/14 Status changed to "Testing and Interview"

09/08/14 Received another email saying EAD was approved :wacko:

Hm same here, I was born in the UK (mother is UK citizen, father is Dutch) but I've never had a UK passport, only Dutch. I used to be included in my mother's passport when I was little but have had only a Dutch passport for decades, have been living in the Netherlands since I was 3 years old. When the forms asked for nationality I just filled in "Netherlands/Dutch".
