can i work even had expired fiance visa? (merged)

seen in uscis site that could work even under fiance visa and as long as file for application for employment. but then my finace visa was already expired. just havent filed my aos yet even we get marry before my visa expire. now im wondering if i could work even havent filed yet my adjustment of status? TIA

No you cannot work until you have applied to AOS with the EAD and received the employment authorization.

Even if you filed work for authorization (EAD) alone it will expired as same time with your I-94. And you can't work if you not filed AoS yet. At least you need EAD approval during your AoS process to be able to work.

In order to have legal authorization to work, you have to receive your EAD card first (or GC whichever comes first). The fees for EAD and AP are waived when you apply this with your AOS.

Btw, your K1 visa expired the moment you went through immigration at your POE. It is your I-94 that determines your 90 day legal stay in US and the expiration date on your visa only sets the last day that you can enter US.

No you cannot work, because you would have to show your potential employer that you can legally work in the U.S. You would have to show them a work permit or a green card. So, in order to legally work you would have to file the AOS.

Your K1 expired the instant you entered the USA. Your I-94 expires within 90 days of entry. After that you're not legally in the USA until you file for the AOS. At that time file for the EAD and you can start working in 90 days. Do not work illegally. You can be deported.

Alright this is my experience, my fiance visa was expired, but i found a job before it expired, so i filed for employment authorization and it was approved and received the card after three months, my employer asked for proof and i explained to them the process and i showed them a letter from USCIS stating that they extended my stay for one year while my AOS is in process and it all worked out.

Seems you take this very lightly, WHAT have you been waiting for? You know what is required, and you have done pretty much nothing.,.,take care of your wife.,.,you can do this and a speedy documentation back to you! (EAD)
