The point is that alcohol affects people differently - there's a legal average, but if the person appears to be impaired at a lower level I think it's reasonable to arrest them.

I agree doing anything that severely distracts from your ability to drive should be punished equally, especially if you injure or kill someone.

And the 21 law doesn't seem to work either.

The average starting age is 16.1 years old. By 18, 65% have been drinking.

I can't find a stat for college students under 21 but that percentage probably climbs into the 80% range.

Again, I believe alcohol to be the exception to that rule. For some reason everyone wants it and has to have it at a very young age. I'm sure there are many factors that play into that mindset such as the taboo and glamorization of alcohol. I still believe however that the current laws in place do act as a deterrent against kids drinking to a certain extent.

According to Slim, that would be the fault of the victim for not protecting himself, not the drunk driver who was simply exercising his/her right to get blasted.

That I have to strongly agree with then. There must be a scientific level of evidence to charge someone. How someone seems to an officer is not credible evidence, they could just be a little tired for instance.

Alcohol is a fundamental part of human evolution, I think thats why.

Yeah but tiredness will also get you arrested. Here a few years ago, there was a guy who fell asleep at the wheel (apparently after staying up to crazy hours on dating websites), rolled his car onto train tracks and caused a derailment which killed several people. He was jailed for manslaughter.

True, alcohol does play a big part in the stages of human life and the "rights to passage". From the day we are born we are taught that the proper way to celebrate any achievement is with alcohol.

Most people that are pulled over for sleepiness just get told by the police to stop driving until they sleep unless they are a few miles from home; but I can understand the situation above due to the fatalities.

A friend of mine got a DUI in Hardee's drive thru. #truestory

I got one when I was 20 in Jacksonville NC (Camp Lejeune). BAC of 0.08 which was about 3 beers on my 140 lb. frame. I was sitting on my bike waiting for a friend outside a titty bar. Is that more redneck than a Hardee's drive thru?

Slightly but only because of the combo bike and titty bar. Unless the girls were decent and it was a speed bike. Then it's just fun times.

oh....and I was underage, it was a wicked fast bike and the girls all looked like Cambodian crack whores. It was like 4 in the afternoon on a Sunday. The cop called me a Yankee punk jarhead when he saw my Massachusetts DL. I told him I was the best thing that ever happened to his hick town as he shoved me into his cruiser. I didn't get a phone call for many hours after that.
