Hi All!

My Fiancé and I have pretty much everything in order to send off for the K-1 Visa. He's from the UK and has gone about 2 years without filing (not sure if that's what they call it), his taxes over there. Would this be an issue that could possibly delay the visa process or even deny it? If so, we'd like to know in advance so we can remedy the situation sooner than we had initially expected to.

And as a side note question...for the medical examination, I read that they will look through your medical records. Is this correct? And if so, is this just to make sure the person doesn’t have a severe illness?

Hi!

1. Is your fiancé the beneficiary? His UK taxes have nothing to do with the K1 visa, they want to see the USC (united states citizen) petitioner/applicant's most recent tax return, which would be 2013, for purposes of proving income. You will read a lot of people say that is only for self employed, and yes it does say that in the instructions for the afidavit of support, but they do like seeing it at the interview (the 1040 + w2) not to mention you will need to provide the last 3 years U.S. tax returns for the AOS I864 and meeting 125% above poverty line for whichever number household the sponsor is supporting (they look at line 22 of the 1040 tax return for this).

2. They require a medical for the K1 visa to be issued, this involves looking at your vaccination history (you need MMR, tDAP, varicella, and flu shot if it is the season for it), chest x-ray for TB, a physical, and a questionaire asking about drug use, mental health, and other serious medical conditions.

If you have a serious medical issue they will note it down.

He will have to undergo a medical examination I-693 to make sure he is healthy and he doesn't have diseases like TB. They will take blood samples, etc. Also make sure he has all the proper vaccinations (Dtap). He can get those vaccinations with the civil surgeon that will do his examination if he doesn't have the vaccines but it will cost more money.

As noted above my sweetswinks, your fiance's taxes info won't be a factor in his K1 visa application, only the USC petitioner's income matters.

They will not be seeing a civil surgeon or getting an I-693. They are applying for a K-1 visa at the consulate in London.
