Hi!

I'll try to keep this brief (and hopefully I am posting this in the right place?)

I am the American citizen and married to my British husband, and have been married and living in the UK for 7 1/2 years. We have 2 (they have US & UK passports already) children.

We want to move to the US next summer (2015.)

Our plan is that we file the I-130 while I am still here and then I move to the US with the kids to sort everything out and he will join us a few months later.

Can we do this? Do I only need to be around in the UK during the filing of the I-130 and can go after?

Should I wait until he receives approval from the I-130 before I go? Can he do the rest of the process on his own within the UK while I am in the US?

We're trying to time it out so I can go in July and then he'd go around November. I wanted to go over earlier in the summer so I can set up our life, get kids registered in a school, etcetera, since we will almost be starting over, and he was going to stay behind a few months while living with his mother before moving to the US to save money so we can get off to a good start.

sounds like youve got a good plan. thats correct, you only need to be there to file the i-130, the rest can be done by him there alone. depends on you, but some wait for the approval, just to be sure. you have a good plan, setting up domicile and gathering evidence to send with the 1-864. should be able to time it out however you want, the process moves really fast for dcf, if you want it to.

Ahh, great! I have been reading over and over but, despite doing all the immigration stuff for myself here in the UK, I still never feel like I grasp all of it at times. :)

Roughly, how do the filings time out? I have made a list of all of the forms that will be needed and each form's fee (we're trying to work out how much we need, and when, in all of our planning)... but what is the timeline of filing these forms?

Either way, that's great to hear that we can indeed do it that way. Just need to figure out when we'll need to file the I-130. I'm guessing May 2015 should be a good month to do it and then I go in July and he continues to do all the necessary steps like medical, etcetera, and he can then fly over in November.

No harm in doing it a bit earlier, just in case.

Likewise if you have not got your UK passport, do it before you leave.

The only other thing is the I 864, do you have a co sponsor if needed?

I have many people within my family that could help me with that. I definitely can't be the sponsor, nor can my mother (she was recently made unemployed.) But I have one of my two older brothers who meet the requirement or perhaps my step mother, too. So, hopefully, one of those should be okay.

I know it needs to be 125% above poverty level... so, roughly, how much would that be (salary-wise?) I am TERRIBLE at math and percentages! :wacko:

It will go up next year and they have to include members of their household, but not a lot.
