Today, my stepdaughter and I went to her K2 interview. At the interview the lady justed wanted to see a few documents in regards to my wife's I-485 not my step daughters I-485. I read the interview letter and it stated that no documents were needed except the orignals we submitted for my stepdaughter. The documents they wanted to see were A) Lease rental agreement B) Health/Life Insurance policy with her name on it and any two other documents with both our names on it. She did say if we submit those documents by Friday both my Wife and Step daughter will be issued there green cards.

The problem is A) Lease/Rental Agreement from April 2013 to July 2014 we lived at my dad's house- In May 2014 we paid a deposit for a Rental lease but we did not sign the rental lease until July 9th, 2014 due to the fact we waited for the girls to finish school and did not officially move in until July. Will it be an issue that the lease date is 5-16-2014 and the actual lease was signed on July 9th 2014. (Her's and my name were witnessed on the July 9th of the lease).

B) Health insurance is no problem I have documentation with her's and my name on the insurance starting July 3rd 2013. The life insurance and 401k might be a problem. When I got married and received the marraige cert. I went to our benefits office and asked them to update those documents at the same time I put her own my insurance. (shocker) When I got those forms today she is listed on the 401k with her maiden name and listed as Fiancee dated 6/5/2012 and on my life insurance she is listed with her maiden name and listed a fiancee since 5/12/2009. My question is will this be an issue since she was not updated as my wife even though she is still listed.

C) I do have our car insurance card with her listed on it but the card is July 11th, 2014. The previous state we lived in would not list her on the insurance since she did not have a license or work permit. Will this cause an issue.

What other evidence could I present we could not open a bank account because she did not have a work permit and her ssn# could not get validated until after her work permit arrived.

Actual wording of letter we got from agent:

Please submit evidence of a bona fide marraige and share life. (Examples include but are limited to the following: Utility bills, bank/Investment accounts, health/life insurance in both names, purchases made together, etc. These documents must show dates.

Again, she stated once we present these documents they will be issued there cards.

Any input would be helpful.

Also, add her as your emergency contact at work, or person on your medical proxy. We also have our rings engraved with our names. Your could at least add her to your utility bills and cellphone family plan. Authorise user on your credit card account etc.

You don't need a work permit or social to open accounts. I don't cAre what they tell you. I have successfully opened accounts, checking and credit without SSN with BOA, AMEX and citi. Go to a banking branch and speak to a manager.

Opening accounts now, after the RFE for evidence at the interview will not be helpful. They want to see that they already had began to live as a married couple and co-mingling their lives and not just because they were told to do it for a green card.

OP, provide whatever evidence you can possibly find that you have together. Both names on children's school papers as emergency contacts, parents, authorized to pick up them from school, etc. Get your father to sign an affidavit attesting to the fact that you were living as a married couple and family in his house during whatever the dates were you there when first married. Hand that over with the lease you have now. Provide the car and health insurance items and anything else you can think of that could help. They really will understand that your marriage is new and you will not have much co-mingling evidence and that some will be recent, since the marriage is too.

You can also have close family and friends submit notarized affidavits attesting the good faith marriage. There are form letters you can find online that cover all the important points, like when they met you, the nature of your relationship, etc. They don't weigh very much but every little bit counts. If you know any public figures who would be willing to do this for you then that is a bonus.

1) My wife could not get her social security card fixed until her work permit was issued. She received her work permit end of June 2014. When I went to put her on the Electric and Gas Bill they said they could not add her until she had a valid SSN.

2) When we tried to place my wife on the bank account her social security number came back not verified. (Hence that was when we found out they could not do anything until work permit)

Again, the lady that was at the interview stated she only needed 4 documents. I have the health/dental policy, I have the IRS Tax Receipt showing we filed jointly, I have our lease/rental agreeement. My real question is since my wife was already listed as my beneficiary on my life insurance and 401k since 2009 in her maiden name and as my fiancee would that be an issue. Because under State Law once we got married she automatically would be the beneficiary. If I could use these two then I would have the 4 documents. I could go to the Highschool and get the school forms we signed and the middle school.

Looks pretty good to me. Dental bill for the child with both names is a good addition. If you wish, you could add on a note stating that she was added as beneficiary to the insurance and 401k before you married and the name has not been changed from her maiden to her married name on those as of yet.
