Hi everyone, i'm not sure if this is the right section to post my question so i'm sorry if i'm wrong.

I'm from italy, i'm actually in us under the Visa Waiver Program. I'v met my girlfriend online some months ago and we decided to meet and have some time together and see how things work.

We were planning to spend my 90 days permit here and then go back in italy and get married (i'v entered with round trip tickets to italy)

The fact is my mom's girlfriend is under chemo treatments for cancer and i realized that i didn't want to separate them. So we decided to marry here ( on the 18th of this month ) and ask for the AOS.

Is this considered an attempt to fraud? Are we under the risk of being separated and me banned from the country?

Thanks in advance for any informations or help you could give us.

You can AOS from VWP. It is not a problem. Follow the links ---> http://www.visajourney.com/content/guides

Bear in mind that you will not be able to return home until you receive your Advance Parole, which means you will be bound stateside for at least 90 days - if you have lose ends to tie up back in Italy.

Other than that, your relationship being bona fide, you are within the law.

Is this considered an attempt to fraud? No since you had no intention of immigrating when you entered. Are we under the risk of being separated and me banned from the country? No.

You can marry and adjust.

You would only have a problem if you lied at the POE.

US law states that even if you had the preconceived intent to immigrate when you entered, it is not a valid reason to deny the AOS of an Immediate Relative of USC as long as the person did not lie at the POE.

POE - port of entry. Generally, the airport where you crossed the US border.

Not true about chemo.

There are many types of cancers and many types of chemo.

My brother has colon cancer and 12-14 inches of his colon has been removed. His chemo was very mild, and no one could tell that he was receiving it. He exercised every day and had normal activities. Nausea was the worst side effect which only occurred in the 2-3 days after his infusion. Glad to say he is in remission.

My brother will never be the same because of the cancer. The chemo did not have any long term side effects.

Mild dose may mean mild effects, hopefully he will get back to close where he was.
