Re-open DS260 to attach husband

Hi all,

I once posted a related question but now things changed :)

Actually, I've been dating my fiance for 8 years now and she has been selected lately as part of dv 2015 as single. At first we thought that everything is quick and won't take more than 2 months so we went ahead and filled in the DS260 form as single (we thought that we will figure out how to get together after the wedding). But now thanks to everyone's help here, I realized that based on her number AF82XXX, she won't be interviewed before August/September (if not never due to the cut off number). which will be in the same period of our planned wedding (around July 2015 ).

Now, my question is : when should we request the ds260 update to add me as a spouse? is it right after the wedding? will 2 months be enough and not cause her DS260 to be dropped ? or should we go ahead and request that ASAP?

There is nothing to update until you are married. You are not her spouse until after the wedding in July 2015.

If she gets her visa before you get married, then you are not immigrating with her. She will need to immigrate alone and then file for a spousal visa for you which will take 2-3 years.

The number indeed looks borderline for interview, but no-one can say for sure. Last year numbers were interviewed much higher than that. But yes, August /September looks most likely if you interview.

Now: as above, you cannot be added to the DS until you have a marriage certificate. But do it immediately after you get married. Then, suck up the cost of a long distance call, and phone KCC to ensure that the spouse name will be on the interview letter when it goes out. Even if it has already gone out, speak to them. If they say they no longer have your file, call the embassy and make sure the spouse gets on the interview list.

Contrary to above, there is a way to get a spouse visa after the main one, ie follow to join, but you won't have time for that with that case number.

Also if you get an interview, be sure to take as much evidence of a bona fide relationship as you can. You won't have much time if they decide they need extra evidence...

Thanks Aaron and Susie for your answers. Let's hope we make it to the interview :) i'm getting a bit stressed after seeing the cutoff number.

When you say evidence, would having an 8 years timelined picture album + mariage certificate be sufficient ? Can you imagine anything else that we should bring with us?

Yes, photos across time in different places and with different people is good. Also things like mail addressed to each of you at same address, shared bills etc if you have any of those.

If you want a chance to immigrate with her, then get marry today.

With an 8 years relationship, you shouldn't have a bona fide marriage problem.

What is a red flag is marriage after winning the DV. The US is concern here with marriage fraud for an immigration visa.

Thanks Susie, I can gather more evidence as well :)

Aaron, we can't get married immediately, we were planning to do it this summer regardless the interview/Visa but lately my father past away and we had to reschedule to next year (cultural thing : you can't get married when your father just died).

I can show the google spreadsheet of the plan that we made last april (before the results) to convince KCC that this is not related to winning the DV, but more to being together (not splitting for 3 years until I get a visa).

Yeh I agree just do the legal marriage in a government office and do the wedding ceremony next year as planned.

I disagree that you can wait a couple of months because the 50,000 DV visas for DV-2014 will run out by the end of the fiscal year. You must apply for a visa by the deadline of September 30, 2014.

I agree with others. Why base an entire life and struggles around a ceremony.. Legally wed now and have your ceremony at a later date. We did ours in court in the USA and a year later had a ceremony in Russia for her family. Also takes a lot of pressure off the planning!

They're DV2015. Interviews run from Oct 2014 to Sep 2015 and they are likely to be at the end of that....
