Hi VJers,



We are in the initial step of filing an I-130 for my daughter. My USC husband, who is the step-parent of my daughter will be the petitioner.


I would like to ask confirmation if with the following documents below will suffice in a petition approval?




- Filing Fee of $420


- I-130 petition for minor, unmarried child


- child's birth certificate (does not reflect the biological father's name)


- USC birth certificate & passport


- USC and biological mother marriage certificate


- biological mother's birth certificate


- photos of my husband with me & my daughter


-G1145 notification



Hoping for your response--we will be mailing petition in the next couple of days.

Hi VJers,

question you mentioned that you are submitting your United States Citizenship and your birth certificate. if you are a citizen why don't you put in the petition for your daughter and when it's time for the affidavit of support then you use your husband. that is what i did. and my kids are now waiting on their interview dates.

filed:10-10-2014

uscis received application: 10-19-2014

got approved 05-08-2012

got approval letter

USCIS alao sent it over to NVC

NVC received it on 05-22-2014

i waited 30 days then called NVC

received case # on 06-22-2014

NVC told me to wait three weeks for

AOS invoice number.

Got affidavit invoice 06-30-2014

payed affidavit of support 07-02-2014

send requested documents with AOS form filled out 07-17-2014

now waiting on NVC to make a decision

next step physical and interview i will keep you updated.

Hi! I am with the same question. My husband will be filing for his step child (who is my biological daughter). Do we REALLY need pictures ? Because he does not have pictures with her. In fact he has never seen her in person, only by phone and skype.

Hi,

There is no requirement for pictures.

There is no requirement that they have met.

hi everyone. my daughter is coming to the us thru the k2 visa since she was included in the k1 petition. we are no longer going through the i-130 process. thankfully i am going home next week to appear for her interview and travel back to the us

Another VJer told me you can send in money remittances receipts in that way it shows husband is supporting your child. It does help. ☺️ Goodluck

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I have so e more questions. How does bringing a minor step child over here look like?? My USC husband is going to petition for his step daughter.

If it hopefully gets approved, what's next???

And how will the child go through the interview process being apart from me??

Can my mother accompany this minor child and be with her during interview??

Will a child have to go through medical exam too???

Sorry I am so confused and I just would like what to expect :(

Will I need a written consent from child's father (my ex husband?)

3. If you are currently married, enter "1" for

your spouse.

6If you have sponsored any other persons on an I-864 or I-864 EZ who are now lawful permanent residents, enter the number here.

Overview: hubby is single no kids, mom has 2kids.

Since my husband is petitioning my two kids..part3 item 7 for each kids would be 1 right?

Then on part5 sponsors household..item 1 is 1, item 2 is 1, item3 is 1,should we put 1 on item 4where it ask any dependents for the second child to make the total household size 4?

My lawyer might be doing the same mistake on my checklist i need some answers.
