Hi everyone,

Received an RFE in the mail today for my I-485 wanting the most recent tax return for my joint sponsor and also stating that he did not meet the minimum income requirements.

My joint sponsor is self employed.

I provided a 2012 tax return for my joint sponsor as he requested an extension from the IRS and won't be doing the most recent tax year(2013) return until October. I was wondering if I can just send back a letter to USCIS to that effect providing proof of his extension? Or will they request he does his tax return now or suggest I find another sponsor? Anyone have any experience with this or something similar or want to take a guess?

His 2012 return puts him $10,000 over the 125% poverty guideline.

I called the USCIS call centre for assistance but they just directed me to a list of free legal providers or to make an infopass appointment. Unfortunately there are no infopass appointments available at this time at the Los Angeles office and I'm waiting to hear back from some of the lawyers who do probono work from the list on the DoJ website.

Any help would be fantastic.

Self-employed use their tax transcripts to prove their income. If your joint sponsor has not filed their 2013 taxes and cannot prove their income, then you need to find another joint sponsor.

Please find another joint sponsor. Explanation letter will not help, if you cannot provide them with what they need, they will deny you case eventually and you will end up losing your filing fee.
