As the topic reads we are scheduled for our AOS interview on July 30th. We are yet to recieve her passport from her embassy back with the name change. Over 2 months now. My question is can we attend the interview without her passport?

She has State ID card which expired with the I-94 date. Social under her new name, and EAD under her new name. Since the GC is no longer printed in the passport can we go without this document? We have color photocopies of the old passport ID page as well.

GC? Green card? She never had a green card. She is going to the AOS interview to be approved for a green card. Her K-1 visa was in her passport.

If you do not have the passport back in time for the interview, then you can enter with another valid photo ID. The EAD should work, as it is listed by some local offices as acceptable ID to enter. Take both the expired state ID and EAD with you, along with your appointment letter.

The I-485 requires that you provide a copy of the passport page with the K-1 visa in it(this is the forum for adjusting from a K-1, if you used some other visa to enter, then you would have provided that instead). It is not used as ID for an AOS application. They can take the copy they still have of the K-1 visa from the passport. They will be able to enter and attend the interview. If they still do not have the passport back and the IO should happen to want it, then the IO will let them know that at the interview.

I thought you need to take your passport because thats the id you filed your aos with.

Her name changed from the passport she entered with. USCIS knows this and issued her EAD under her knew name. Due to issues with the DMV they won't move her maiden name to the middle name and allow her to take my last name. Social Security, banks cards, and everything else is already under the new name and DMV said maybe after her country changes her name. They only allow a hypenated last name or just my last name which would be disrespectful in her country.

The I-485 was submitted with the copies of her passport page and the page with the K-1 visa. I'm hoping it will be back to us in time however, I'm preparing in case we don't get the new passport in time. Can hardly believe it's taken them 8 weeks and counting now. Her expired ID is under her maiden name...the social and EAD are under her new married name.

I guess we can go and then if they request more information, then we will just continue to wait.

Attended AOS interview with only the EAD card. No issues and they approved the GC.
