Hi there,

I'm preparing to send in my papers for I-130, I-485, I-765 and I-864

I've read in the instructions somewhere that I should post them my I-864 form, but others where it said it will mail it to me when the time comes instead

Would it be better to just mail it all in at once or wait for them to mail it to me?

My second (and more concerning) question is that on form I-864 it requires "the transcript of the last federal tax return"

My sponsor (my husband) was visiting me in Australia last year, from feb 2013-2014 and I don't believe he filed for any tax (because he didn't work)

We're going to file for form I-864a as he doesn't meet the required poverty minimum right now anyways, but what should I do for that portion?

Do I just skip it, write a note on a separate piece of paper explaining why there is no tax return or something else?

Thank you !

You need to mail the I-864 with those 3 documents or else you will get an RFE and slow down your entire AOS process.

Not quite sure about this one, someone else will be able to chime in for sure, but I am guessing you have to get something from the IRS stating he had no taxable income (TRANSCRIPT) would work but not 100% sure.

Thank you !
