USC wants to sponsor Mother who is currently in the US on Visitor Visa

Hello,

Can someone please advise whether it is possible for me, a US Citizen, to sponsor my mother for a green card? She is currently staying with me, and she came here on a visitor visa.

I think I'm supposed to file I 485, and within it petition her permanent residence. Is that correct?

What is the procedure, and how long can I expect the process to take in this situation?

Yes you can apply for your mother while she is in in US. Since she is already here, you have the option of filing the I-130 and simultaneously filing the I-485 (for your mother) in a one step process.

Of course you can also file the I-130 first, then when it is approved you can submit the I-485 later. That

way you pay the fees in stages.

sorry to hi-jack. How long can she stay in USA as a visitor? I know it could take up to a year for NOA2 for I-130 and maybe a few month in NVC. Does she have to go back to her country? Or Visitor Visa can extend until she has GC? thx

If this is the case, can I have my sister (under 21) to visit US and then file I-130/I-485 without going back to her country?

You sister is not an immediate relative in immigrations eyes and no she can't adjust status in the US. Using a vistors visa to enter with the intent of adjusting is fraud and could result in a lifetime ban. TO file for a sister will take over a decade before she will be in lie for a visa. depending on her age , once your mother gets her status she may be able to shorten the part ( if the sister remains single )

This will not be over quickly. You will not enjoy this.

So that mean only parent(s) can "do" the visitor to USA and then apply for GC w/out going back to the country?

Immediate relatives are a category of prospective immigrants who include a U.S. citizen's spouse, minor children (under the age of 21), and parents (so long as the citizen is at least 21 years old).

If I knew this, i would have my mom stay and apply for GC w/out going back to Cambodia but then it's ok since now we just wait for her interview date.

hey ! file I-130 plus I-485, concurrently, along with the ancillary forms, pay some monies along with it, and wait.

filing just the I-130 won't allow mumsie to stay inside the usa.

Can you do that? Parents visiting on B2 visa and then you can adjust status after 60 or 90 days?
