Quick DCF Question

Hi there, got a quick question for you guys :)

I (UK citizen) Met Fiancee (US Citizen) 19 Months ago in USA while doing an internship (J1 visa). We both came back to the UK for her to study and for me to finish my degree. We got engaged over the christmas period.

She (The US Citizen) is in the UK until Early August 07 and has been here since September 06. We were told by an 'expert' that we would be elligable for DCF instead of applying for a K-1. I am not sure I believe them...

She is on a student visa to study in the UK and I wasn't aware that would make us eligable, but I guess maybe?!

Anyone else been in the situation or can enlighten me, I would greatly appreciate it.

2007:

February, 06: Sent I-129f package to the US to be routed to Vermont

February, 09: I-129f forwarded to Vermont USCIS from US Home

February, 12: I-129f arrives VSC :) Journey really starts!

February, 13: NOA1 Reciept date

February, 16: VSC Cashes the check

March, 09: NOA2 Email. yay!

March, 11: Touched... Probably for the last time at VSC :)

March, 14: NVC Recieved package

March, 15: NVC Sent package to London

March, 20: Package recieved in London

March, 28: Packet 3 recieved!

April, 2: Packet 3 Sent back to London

April, 10: Packet 3 recieved by London Embassy

April, 17: Packet 4 recieved

May, 1: Medical

May, 29: Interview! - APPROVED

June, 1: Visa in Hand

July 18: Fly back together POE

July, 24: Legally married!

July 27: Filed for AOS

July 30: AOS recieved in Chiacgo

August 24: NOA1 for EAD, AP and AOS

September 15: Real Marriage with friends and family

September 18: Biometrics

October 3: EAD card production ordered!

October 11: EAD card in hand!

October 15: Case forwarded to California!

Nov, 08: Card production ordered! AWESOME

Nov, 15: Green Card Recieved (even though it's yellow)! AWESOME

I would say the "Expert" is wrong. The USC has to have longer residency than that...i THINK but do a search on London DCF. The topic has been discussed.

Finally finished with immigration in 2012!

i would check specifically with the emabssy you will be under.

each is slightly different

i applied for DCF through delhi

indeed one of the reasons you qualified to apply through dcf was being on a student visa

acually nearly any long term visa applies

ie not tourist reasons for being in the country

however - i was on a toursit visa and i was still able to apply dcf

the rule at delhi was 90 days stay

definetly look into it, it will save you time!

also - not sure how it will work in london, but

in delhi you dont pay for the application unless you are approved.

if you are denied they just escort you out

in other words - nothing to lose by trying.

in fact 1 couple got denied but got tons of info while they were there

anyways - i dont think you can do fiance visas through DCF

only immigration visas (ie sposal visa)

however - you should check because i could be wrong on that.

best thing to do is to CALL the embassy

you can check thier website, but i found that false info is on the website for delhi.

i just checked the i130 form - there is no box for any fiance visa

only boxes are for family visas

spouse, child, parent, brother/sister

so youll have to get married before you can apply

Summer 2005 Met in Delhi

Oct 2006 Married in Delhi

Apr 2007 Manu Arrives in the US

Sep 2008 Our son is born

Jun 2009 Removal of conditions (approved in 2 months!)

Dec 2010 Many Becomes citizen!

Aug 2011 Son #2 is born!

Nov 2012 Mom Immigrated

Jan 2012 Waiting for dad...
