F1 Student Visa Question :)

Timeline

Hello,
I am from Nigeria and i am planning to attend an 8 week course in USA.

I want to know how long i would be allowed to stay in the USA after the course. It is my first time and i would love to spend 1 month extra for a vacation.

My friend told me that after my Visa F1 expires i have 3 months grace to be in the USA.

I do not want to take changes so i would appreciate a sound and well informed advice.

Hi TruBrotha,

Only the immigration officer at the airport can determine how long you are allowed to stay. While your course is 8 weeks, you may get stamped with a later date on your I-94 that will tell you how long you will be able to be in the USA.

That does not sound logical to you does it? You have an 8 week course but then get a free 90 day tourist visa?

The 30 day grace period typically goes for students who have been in the US for years, it allows them time to settle affairs in the US prior to leaving.

Student visa stamps with a notation says d/s . You are permitted to stay until your i20 expires. Then you have 60 days (this is what I was told by my school ) to pack your stuff and leave.

What kind of programme is it ? Do you already have an I20? I don't know if your 8 weeks course is an academic programme.

This is not accurate -- you cannot stay until your I-20 expires. You can stay (if admitted duration of status) until you finish the program....that may be before or after the I-20 expires (although it it's after, the school should make sure they extend it, just to be safe). However, for a relatively short program (8 weeks), the immigration officer may, in fact, not grant D/S and instead give a date specific. It is highly unlikely that they will allow 60 days grace period to leave the US after a course of study that was less than that (56 days, including weekends).

Not all student visa's will state "D/S". F1 student visa's typically have "D/S" stamped, while the M1 student visa's will have a specific date.

For a specific 8-week, program, it sounds like a vocational program, meaning it should have gone under the M1 Visa if it is vocational studies.

This is not accurate -- you cannot stay until your I-20 expires. You can stay (if admitted duration of status) until you finish the program....that may be before or after the I-20 expires (although it it's after, the school should make sure they extend it, just to be safe). However, for a relatively short program (8 weeks), the immigration officer may, in fact, not grant D/S and instead give a date specific. It is highly unlikely that they will allow 60 days grace period to leave the US after a course of study that was less than that (56 days, including weekends).

Whether the student visa expires or not, whether the i20 expires or not, AS LONG AS the student is maintaining status as a full-time student, s/he will be legally allowed to stay until their studies are completed. If the I20 expires, the DSO at their school should give them an updated I20 with a new date.

Best advice is to ask your Designated School Official (DSO). Every foreign student is assigned a DSO within the university/school regarding immigration procedures. You should definitely get in touch with yours. Seeing as this is a very, very short course period (2 months), only your DSO will know how long your departure preparation period ("grace period") may be.
