Fiance of Memphis Judge Accused of Paying Woman for Sex With 8-Year-Old Daughter

MEMPHIS, Tenn. — A sheriff's department employee is charged with paying a woman for sex with her 8-year-old daughter, and a special judge was called from out of town for a bond hearing Wednesday because the accused is engaged to a Memphis judge.

Wayne Logan appeared in court Tuesday for a preliminary hearing on child rape charges, but all of the county's judges who preside over such matters recused themselves.

"The General Sessions judges have all agreed that it would be inappropriate for any of them to hear Mr. Logan's case based on Mr. Logan's relationship with a sitting General Sessions judge. His fiancee is a General Sessions judge," defense lawyer Leslie Ballin told WMC-TV.

Steve Daniel, a retired judge from Murfreesboro, conducted the rescheduled hearing and reduced Logan's bond from $150,000 to $75,000. Logan remained in jail without making bond and was scheduled for his next court appearance on Feb. 5.

Logan, 60, is engaged to Judge Joyce Broffitt and records show he used her as a reference when he got his job in the sheriff's department's records and identification office about six years ago. He is on paid leave while the case is pending.

The rape charge was filed when the girl picked Logan out of a photo lineup, police spokesman Vince Higgins said.

Police began an assault investigation after the girl complained of pain while at school. She told the school staff she had sex with a man several times and watched him have sex with her mother, who also faces criminal charges.

In Tennessee, general sessions judges handle misdemeanor cases, arraignments and bond hearings and decide whether felony cases will be sent to the grand jury.

I do understand that some people are new to the USA but there is an irritating little thing here called the constitution and a presumption of innocence until proven guilty not the other way around. :whistle:

Not sure where you were headed with this statement, but I have been an American by birth for 41 years. With due process in mind, I surmise guilt in this case. We shall see.

Our constitution, unfortunately, does not issue equal justice for crime. Penalties for crimes such as this, should be severe. Likely, the azz hole, if found guilty, will serve 5-8 years in prison. Meanwhile, the victim will spend the rest of her life paying an undue penalty.

I do understand that some people are new to the USA but there is an irritating little thing here called the constitution and a presumption of innocence until proven guilty not the other way around. :whistle:

Bizarre ppl. The people (parents) who you would think are going to do anything in their power to protect the child is now exploiting them. Just sick, morbid in fact. :angry: And the saddest part is this person seems to be *protected* and will surely not do get the real punishment desevring this crime. And the most saddest part here that is these exploioted and abused children never totally recover. Many grow up but never live full lives. I pray that this girl will be able to overcome this.

It had to be hard for that little girl to come forward with all this... and it will continue to be hard as they attack her testimony. How would a little girl come up with this if it wasn't true?

Presumed innocent? What of that little girl? We are soooo worried about the RIGHTS of the guilty that we ignore the victims.

Psychological suggestion has been known to happen. Series of 'teacher/daddy molested me!' in the 80s were found to have been fabricated, not because the child lied, and not because the psychologist was malicious, but simply because the child recognized a leading question and wanted to please the psychologist.

The phenomenon wasn't well studied at the time, now it is, but not until many lives were ruined: the parents, having had their kids taken away, and the kids, who ended up with false memories of being abused, being taken from their parents, and feeling guilty for ruining their dad's lives.

Presumed innocent is how it works. "We're so worried about the rights of the guilty..." how do you know he's guilty? I'm serious. The infallibility of identifications in police line-ups? Because the judges rightly recused themselves? Because he had a preliminary hearing? So did some members of the Duke lacrosse team and WE DIDN'T SHOOT THEM.

No problems with taking sides in the court of public opinion, or calling the crime heinous, or in surmising guilt. But suggesting that 'presumed innocent' is just an unnecessary things that protects criminals....come on.

Yes, but the psychological suggestion comes with questioning. The girl complained FIRST - not AFTER being questioned.

I'm in the state (Mass.) with the famed Fells Acres case, where two of the three accused (and convicted) were finally released and convictions overturned because of psychological suggestion (and the fact that the accused were never allowed to confront their accusers). I understand that it can happen, but in this case, it seems that the girl came forward, complained, and then was questioned.
