I just found out that my mother in law passed away, I need to apply for an emergency visa. On website it says that the person has to be immediate relative. Does mother in law comes under that category???

It also says on website that I will not be granted emergency visa if I have been denied visa previously within last one year. We have an immigrant visa application and last time when I wanted to visit on nonimmigrant visa they refused it saying I probably wont return back even though I already had immigrant visa application in process at the time. That application was to go attend a 90th birthday party. Now, is that a hindrance for me in getting this emergency situation visa???

Presumably you are looking at a B2, what evidence do you have to show the closeness of your relationship?

Why not use that evidence to try and expedite your case? Ii have a friend who's wife died last Saturday her funeral was Friday. He was died a emergency Visa. His case is at NVC right now.

You can try you still need to show your strong ties to India and why you would return. Seeing they said you wouldn't before I doubt they would change mind you have more of a reason to not return now.

So, just as I was expecting, at the time of taking an appointment, I sent them emergency appointment request along with the funeral letter from the director of the funeral home. Embassy approved my emergency visa request and asked me to make an emergency appointment.

Then when I went to the embassy for the interview, counselor officer asked me questions about me and my wife and where we met and when we got married and why she is there at the moment. After telling her straight forward answers, she replied saying " I'm sorry you will have to wait for your immigrant visa"

P.S. - Didn't even ask to see the funeral letter from me or anything.
