Hi guys.....long story short, fiance and I got approved for the k1 visa on April 18th and we haven't heard anything bout our petition ever since.............we have called and emailed USCIS and NVC, contacted the Obudsman (sp?) and all that.......................so anyway fiance got a letter saying "thank you for your inquiry. The California Service Center has no longer jurisdiction over this petition. This case was approved and has been forwarded to the National Visa Center..."and

and they gave us a referral ID number.........................

so at first i thought that this was sent to us letting us know that things are getting done bout our petition...but then i read it again and realized it is an "inquiry"...and i've sent one out about 2 weeks ago...or less....so that is what it is, right??? cause people don't usually get letters like this, right? Just ones informing them that the case has been received by the NVC...am i right or not???

Anyway, idk what this means......i have two theories.....one is that our petition has been FOREVER now stuck at the NVC..............and they cant find it

or that the CSC just recently mailed our case to the NVC...what do u think? im so furious!!!!!

yeah still havent heard nothing and still the petition isnt at NVC, and if it is, its not in their system so they say its not there....

nobody can tell me where our petition is! but doesnt this letter state than the CSC HAS DEFINITELY SENT IT OUT to NVC???

so we should be only bugging the nvc now right...

If it's not in the hands of NVC then it's CSC who is responsible for your petition and it's them you have to talk to insist on a supervisor if they can't help go to the office in person of your Senator etc to have them look into it for you. This is dragging on just way to long. Please post at the thread I posted for you there are people there that might be able to help. how can it be at the CSC still if they said they sent it off to NVC.........i wish the letter said WHEN they supposedly sent it off to NVC....that would answer so many questions....cuz if they had sent it off a long time ago then it's prob still at the CSC, well maybe at NVC in some room idk....................but if they just recentyl sent it off to the NVC then there's hope it's been found. so confuing

At this point I think you need to contact both of your state Senators and explain to them your situation. That is beyond ridiculous and if they are not giving you proper answers, it's time for you to involve someone who will get some straight answers to your case. I would be livid if I were you, don't back down and keep on them about this. Call daily.

After you rather rude responses to this poster about not reading previous posts, you should be glad he/she has stayed on and tried to give you suggestions at all, let alone demand that they do your research for you about supplying links to YOUR congressional representatives. That info is easily available with a search. I know you're frustrated by the delays, but it's no reason to a) be short with people who are trying to help you, or b) not make a little more effort on your own once given a suggestion.

It would appear your petition was approved at CSC (see red above in your post), and then presumably forwarded to NVC.

One problem is that NVC might not be login in the case until it is ready to be sent out to the Embassy (I recall that a couple of years ago when we were in our case); that can explain they can't tell you anything, even if it's there.

What is strange though is that you do not have a NOA2 (which notifies you o fthe petition approval at CSC).

Did you registed in the USCIS site for notification on e-mail/text?? Have you checked in the USCIS site if there is an 'Approve' status, typically, they would be some dates in there to begin the search.

As others have noted, I think it's time to get help from your congress/state representative, for that you need to send them a signed release so they can act on your behalf. It might just be the NVC is behind (not surprising).

I've done everything I could do myself...Yes, I've checked the case status on their website multiple times, since the very day we received the receipt number, and I still check it once a day just to make sure nothing changes on there. I have signed up for the text/e-mail notifiction and never got any notifications.

I will have my fiance call the two Illinois senators on Monday, and also have him call the NVC before that.

I got one more question guys though, on that inquiry letter from USCIS it states that the USCIS has no longer any kinda "authority" over our petition and that we shall contact the NVC regarding our case, and it gives us a referral ID number. Anything I can do with that ID nr?

One thing I know with USCIS what you say and how you say it means everything because they are idiots. This is what you need to do.

Tomorrow you will call USCIS and request to speak to a Tier 2 supervisor. Mention your reference # you got for your inquiry and say exactly this.

"when did my peititon physically leave the service center?" And wait for their response report back okay.

They told me for over a month my petition was sent to it took me asking that question and talking to a tier 2 supervisor to send my petition.

Approval letters are sent in error everyday. Call tomorrow okay. really sorry for all your delay and grief.

NVC, USCIS and DOS are not the best in terms of being efficient.

Reason I said NVC might not have it login is anecdotal evidence from the time we did our K-1: only when they had scheduled the package to go to Warszawa is when I had a confirmation thay they had it (this was about 10-12 days after I believe it was at NVC), and that after I had already validated myself (DHL trick elsewhere in VJ) that a package was going out that appeared to be our case; the NVC notice arrived 2 weeks later.

Now, in our case, the notice (commonly known as Package 3) from the Embassy was lost in the mail; only because I knew the case was sent to Warszawa and after giving it 4-5 business days and calling the embassy is when I got things moving.

The sad reality is that few civil service employees (be that at NVC, USCIS or DOS) will put the care that each individual -us- does at the cases.

From your posts, it seems clear petition is approved by USCIS and has been sent to NVC (or at least presumed to); if NVC claims they don't have it, it might be because they don't (they never received or it's lost in there). Your fiance representative is the best avenue at this point IMHO, providing him/her with all info, inclusive to the reference number you have form CSC.

Now, it might be worth to look up DHL deliveries (again, look DHL trick elsewhere in VJ), for the past 3 months (or the date of the NOA2); there can't be that many cases for Warszawa and you could do your own search with the Embassy based on those petitions sent. Based on the cases sent, it might be (long shot, but might work) possible to determine if your case has reached Warsaw or not. This is while fiance is doing his part in Illinois with his representative. In the request, I'd advice to list the facts relevant such as USCIS case number, NOA dates, etc; so it's easier for them to locate your petition.

Timeline

One thing I know with USCIS what you say and how you say it means everything because they are idiots. This is what you need to do.

Tomorrow you will call USCIS and request to speak to a Tier 2 supervisor. Mention your reference # you got for your inquiry and say exactly this.

"when did my peititon physically leave the service center?" And wait for their response report back okay.

They told me for over a month my petition was sent to it took me asking that question and talking to a tier 2 supervisor to send my petition.

Approval letters are sent in error everyday. Call tomorrow okay. really sorry for all your delay and grief.

I will have my fiance do that monday....but is there a point if the inquiry says that the USCIS no longer has the petition and can't do anything about it? By the referance number do you mean the referral ID on the inquiry?

Approval letters are sent in error everyday? What do you mean...that some people get noa2's but aren't really approved for the k1?

NVC, USCIS and DOS are not the best in terms of being efficient.

Reason I said NVC might not have it login is anecdotal evidence from the time we did our K-1: only when they had scheduled the package to go to Warszawa is when I had a confirmation thay they had it (this was about 10-12 days after I believe it was at NVC), and that after I had already validated myself (DHL trick elsewhere in VJ) that a package was going out that appeared to be our case; the NVC notice arrived 2 weeks later.

Now, in our case, the notice (commonly known as Package 3) from the Embassy was lost in the mail; only because I knew the case was sent to Warszawa and after giving it 4-5 business days and calling the embassy is when I got things moving.

The sad reality is that few civil service employees (be that at NVC, USCIS or DOS) will put the care that each individual -us- does at the cases.

From your posts, it seems clear petition is approved by USCIS and has been sent to NVC (or at least presumed to); if NVC claims they don't have it, it might be because they don't (they never received or it's lost in there). Your fiance representative is the best avenue at this point IMHO, providing him/her with all info, inclusive to the reference number you have form CSC.

Now, it might be worth to look up DHL deliveries (again, look DHL trick elsewhere in VJ), for the past 3 months (or the date of the NOA2); there can't be that many cases for Warszawa and you could do your own search with the Embassy based on those petitions sent. Based on the cases sent, it might be (long shot, but might work) possible to determine if your case has reached Warsaw or not. This is while fiance is doing his part in Illinois with his representative. In the request, I'd advice to list the facts relevant such as USCIS case number, NOA dates, etc; so it's easier for them to locate your petition.

Woah, this is all a lot to take in, I am slightly confused. Thank you very much for taking time and trying to help us...

This is all so messed up truly. So what is the best way to find out whether our petition has reached Warsaw or not, if all the notices might not even be sent or sent in delay? Doesn't the Warsaw embassy mail ME, the beneficiary, after our case reaches them??? I thought that's what happens...

ps - i googled the dhl thing and the only thing i found is the way to track your petition from nvc to the embassy WHEN you know when it left the nvc....how else can i possibly do this? how did u do this:?
