Hello! As recently stated in another post, my wife and daughter are currently visiting on a tourist visa for a couple of months and we've now decided to AOS here. Since I have already submitted and paid the fees for the CR1/I-130 while she was in her country, do I have to submit and pay for another I-130 along with the I-485 or do I only have to submit and pay the fees for the 485?

Thanks in advance for your help.

You need to submit proof that you already filed the I-130, i.e. send a copy of the NOA1 from the I-130s.

Thanks for your reply Harpa. So I shouldn't need to submit all of the photos, etc. correct? I assume it gets caught up with the I-485 at some point?

The I-130s will be matched up with the I-485s. You just need to do the whole I-485 packet with all the forms, and include your NOA1s from the I-130s, and it will be turned into a concurrent case.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
