Hi fellow VJ'ers - question.

My husband was able to get his SS Card and we got him is drivers license but they only issued it LT (Limited term) and set it to expire when his I-94 expires 8/18/14.

We have filed AOS and have received text notification of the receipt at the Chicago lock box.

My question is how can we get his license renewed before he has his green card? What other documents could we use to show his extended legal presence?

Any help would be greatly appreciated!

The answer varies by state and you'll find hundreds of threads about the same topic and probably many for your own state. Having said that, the rules are similar across the states. Generally they will only extend a DL or State ID to the latest visa expiry date you have. In your case this will be the current date on your I-94. You'll get a later date when you get your approved EAD card though (12 months) and can extend the DL at that point. This causes a gap between the I-94 expiry date and the date you get your EAD - there's nothing that can be done about this.

Check the rules about using your foreign driving licence in Michigan. In Ohio you can do so for 12 months from arrival or until you are granted permanent residency, whichever comes first. Be advised that the rules regarding this really do vary by state.

Michigan list http://www.michigan.gov/documents/DE40_032001_20459_7.pdf indicates I-94 gets you a license until I-94 expires. Receipt of filing AOS (I-797C) won't do because it won't say your AOS is approved. It doesn't extend your stay with a written date or time period. You next dated proof of legal presence will be the EAD card most likely. That will get you a 1 year license because it expires in a year. Next proof and longer stay is the greencard.

Actually AOS reciept is on the list of acceptable documents in Michigan. You can go into the secretary of state and get the list from them.
