Marriage while waiting on K-1 Dominican Republic

Timeline

Does god approve of finding a new woman while still married? That's not defiling anything?

Was married on paper only. Ex left a long time ago and has a new life with two new kids. I filed for divorce only after I found love again. My conscience is clear.

Also the Marriage Visa I believe is cheaper and they come over with a Green Card and permission to work where as K-1's have to pay an additional 1070 to adjust status and wait about 3-4 more months to get work permit and travel permit... and longer for GC.

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

How did you get married in the United States?

Yes, but according to them when I last checked, it was still open but closed based on non-activity. They're useless. Hubby came over on the Visa Waiver Program (VWP) and we got married, plain and simple. He went back to the UK after our honeymoon and I filed the I-130 once I received our Marriage Certificate in the mail, which took a MONTH. He visited every few months after we applied, but remained residing in the UK. I'll also say that they ask if you've filed for a visa for anyone before on the I-130, and I put yes, and included the NOA2 from our I-129F since I was applying for the same person.

I have nothing against people wanting to practice their religion but I am not particularly religious myself.

That said, here is some thought on your situation...don't know if it can work for you guys.

1. Do the official religious wedding ceremony so that you two can be fully intimate.

2. But do not file them into government record in either countries.

3. Continue the I-129F processing so that you are not resetting the visa clock by almost 1 year.

4. Once you are joined in US, simply go to the local county office and get married by peace of justice.

If you can separate the religious ceremony with the official marriage filing with the court,

then, you can be both emotionally and religiously proper for having sex,

but you also keep the current K1 visa processing going.

this is not the greatest advice. there have been many others on here who have been denied for performing a cultural / religious ceremony that was never officially registered with the govt.

You can do it but you have to start over at the beginning with a spousal visa. New petition, new waiting, new everything. Good luck.

Why did you have to withdraw your first petition?

she wasn't legally able to get married due to a very recent divorce the first time he sent the petition.

I want to chime in and second raven52. Going through the visa process (whether K1 or CR1) is really tough - so much is out of your control and you wait, and wait, until you feel like you can't wait any longer - but then you realize that you have no choice but to continue waiting.

Think long and hard about all you'll lose by withdrawing K1 and starting CR1 now. You've paid filing fees twice, and will be signing up to do so a third time. Also remember that you are about halfway towards getting your NOA2. Withdrawing now to start CR1 (which is a longer process) will be moving from a faster moving queue in which you've already made headway, to the back of a very slow queue (CR1 takes 9-18 months right?). I'm sure you filed for K-1 to begin with in part because it was faster than CR1.

My fiance and I have only been separated for ~ 5 months and we've been lucky to have been routed to CSC. Even so, we have struggled with the wait and the feeling that our lives/plans are on hold indefinitely. If you file for CR1 you'll struggle with the wait.
