IR1/CR1 Interview didn't make enough its been over a year now. What happens?

Okay asking for friend.

They had interview April 2013 and got paper that they need a co-sponsor she (petitioner) didn't make enough.

Well they couldn't find one and did nothing, but now she makes enough and wants to continue the process. She doesn't really understand things and I am trying to help her figure out where her petition is. She said she called (someone) and they said the petition has expired. But I-130's don't expire. Do they?

Anyway I asked her to write a letter to embassy asking the status of petition? If they say they sent it back I told her to call USCIS.

Does anyone know does the petition get sent back if you didn't meet the request of the 221g for the Affidavit of support?

I'm sure every request for more documents from Uscis has a finite response window. If and when the dateline is bridged then the petition will be deemed abandoned. I stand to be corrected.

so what happens if its deemed abandoned? how do you start over? do you have to cancel the old one? if you do, how do you cancel it? many questions i know

I-130 do not expire. It likely is with the USCIS at the NRC.

My lawyer told me (when I almost lost my job) that when asked for the Affidavit of Support, there is a finite amount of time before expiration. He told me I have 1 year to respond and after that I would have to start over from scratch on the I-130.

usually, at an IV Unit, one has 1 year to get stuff in after the intervieiw.

since it's been more than a year, might want to find out WHERE the casefile is today.
