Affadavits - An Actual Question

With all my previous posts, I hope I haven't worn out the goodwill of the group where I need actual advice.

Mrs. Tuck called me today and basically said "If you don't get your family to write affadavits, I will cut off your health insurance."

I don't have any actual proof that she said that, but she said it - she later backed off the statement, saying "I don't want to talk about health insurance."

Mrs. Tuck has alienated my entire family with various behavior, including writing hurtful letters to my mother. She was unwelcome at family gatherings long before we separated. She's giving me just a few days to procure these letters.

Now, it would be accurate to say that she was at the family holiday gathering (we don't call it "Christmas" because we're Jewish) for three years. But nobody really wants to help her or write these letters. It's also true that when we had an anniversary dinner for my parents in 2011, which we thought might be the last since my father had just been diagnosed with cancer, we were 45 minutes late because Mrs. Tuck had to go to one more outlet mall.

I've tried to contact USCIS and they have basically told me they can't give me any advice. They told me to make an InfoPass appointment, but Mrs. Tuck is giving me until Sunday to produce the letters.

What should I do? Kiss my health insurance goodbye? Or what? Kind of frustrating that USCIS won't be of any help.

Let's be frank. You did not have a marriage. You two had some odd relationship where your wife used you and you let her. Why did you agree to file a joint petition with someone whose pathetic excuses were one too many? Not only did you sign off on a scam - face it, she is trying to procure residency off of a marriage she never was committed to - but you both provided no evidence that would hold up by the lowest of standards.

You keep asking "what should I do?", "why isn't USCIS more transparent with their standards and procedures?". Really? You should NOT have signed a single thing. Now you are being blackmailed into a situation were your wife is OBVIOUSLY responding to an RFE. Why are you even considering what could be included in an affidavit? WHY? Why should USCIS tell you exactly what to do to so your wife can further scam her way into the US?

So, here is my advice. Call your wife and tell her you are going to retract your support of the joint application, THEN DO IT. Call and write USCIS and RETRACT RETRACT RETRACT. Then, get a divorce and wash your hands clean of this situation you have been enabling and stop pitying yourself. No one deserves a wife like that. Health insurance is your pay off? You want this leech hanging off you for 10 more years? Call her back now and stop being a fool.

I can not see how Affidavits would benefit her so why not just supply why you can get.

You want to risk jail and a fine of $250,000 for some health insurance? Have you looked at getting your own insurance on the health care exchange? There are subsidies if you have low or no income.

My post is link not only to this thread but to previous threads/posts by the OP. Getting family members to write and notarized affidavits showing support of the marriage would be falsification. Surely they would not want to write anything positive for her, but if the OP asks, they may on his behalf. I don't think the OP was planning to supply detrimental affidavits. He seems so far to be complying to the wife's ridiculous requests.

True. Also, judging from the OP's wife's blackmailing attempts, it would not surprise me if she expects falsified "facts" in exchange for health insurance. Nor is there anything stopping her from terminating the insurance anyway. My point is that the OP should not have the family write anything, especially something falsely positive. I think we all agree with that.

It seems like it was not bona fide and she was hesitant the whole time. Why marry someone that you don't want to come home to? Or in his case live with. She is so obviously using him, his relatives probably realise that so for them to claim otherwise in an affidavit would be a blatant lie.

Good grief. Stop trying to help perpetuate this obvious fraud, and extricate yourself from this situation. This person does not care one whit about you.

You can get your own health insurance.
