Timeline

Apparently if I want to get married in the Ukraine I need a document that states I am free to marry.

Do you know where I can get this document?

That is not what he is asking. In order to do DCF in Ukraine you need an apostilled letter that you are free to marry. I have people I know that have done it but it will be this evening before I can get an answer.

Yes it is not the Letter of Intent, it is a Legal document of some sort that tells the Officials in the Ukriane that I am currently not married. Therefore free to marry.

I am drawing from memory here so bear with me. I will tell you there is NO FORM. Everyone has mentioned that this is a really dumb requirement. What I recall one guy do was go to the county courthouse (vital statistics section) and asked them to search there database to verify his marital status. Since he was not previously married they came up with no records. Somehow he got them to sign and notarize a statement that they queried there database and found no records. He then got the document apostilled (if you do not know what this is you may want to find out). He then went to Ukraine, got married at ZAGS and then filed his petition.

Kyiv requires you to make an appointment to file you petition. Appointments are about 3 weeks or so out and apparently only on Thursdays.

When I get home I know of a place that has all this information and I will verify what i have said.

So I thought maybe that we could marry in her country while we were waiting. ;)

If you get legally married in the Ukraine while your K1 is processing, she will not be able to enter the U.S. on the K1.

That was an important fact you left out... If you get married then you have "screwed" yourself as far as the K-1 is concerned. Remember the K-1 is a fiancee visa and not a Spouse visa.

The US Consulate / American services is able to provide you with a letter that states this. It's called a "Letter of Understanding." The court acknowledges this as a legally acceptable document. Contact your closest US Embassy.

Marrying while a K-1 is in process cancels the K-1 and you will have to start all over again and file for a K-3 or CR-1 using the I-130.

Some do a mock wedding while visiting, not a legal wedding in the foreign country, then wait to do the legal ceremony here in the states in front of a judge.

Check out what constitutes as a legal marriage ceremony in the foreign country.

And at the K-1 visa interview avoid "Husband" "Wife" it may cause complications if they suspect marriage while in foreign country.

From another consulate's FAQ

We decided to get married before my K-1 petition could be processed. What should I do?

If you get married, your K-1 petition will no longer be valid. Your spouse will need to file a different petition, Form I-130, with the CIS.

DO NOT GET MARRIED AT ZAGS.... that is the only legally recognized ceremony in Ukraine. If you want to do a church ceremony then that is different.

I was reading all the responses to you message. I was married in Ukraine last November and the "Letter of Non-impediment" which you get at the US Embassy in Kyiv. Its really a silly thing, all it is a form that you fill out in English and Ukrainian, and you swear in front of the consular for $30 saying you are free to marry and are currently not married. Then you take the letter to the Ministry of Foreign Affairs to get it legalized or "recognized" by the ukrainian government. You can only goto the embassy on Friday mornings, takes about 30 minutes, then goto the ministry and drop off by noon and pick up between 4pm and 5:30PM.

After you get this letter, you have to go register and get permission to marry an Ukrainian woman at RAGS. Normally you have to wait to marry for 30 days unless you bring a letter stating you only have two weeks vacation from your employer or a letter from her doctor stating she is pregnant ;) Then you can marry in about 3 days. Ukraine only recognizes marriage at ZAGS as legal. By the way, RAGS is the Regional office that gives you permission to marry, and ZAGS in her home town is actually where you get married. Its like the justice of the peace in the US.

Sonya and I also had a Orthodox wedding, but currently the church does not do weddings till April because of some religious period. If you abandon your K-1, you can marry and file DCF and have her in the US in about 2 months.

told us no VISA was approved for daughter

05/03/07 - Embassy says VISA printed 5/2, but we caught that they forgot VISA for daughter

and the courier entered wrong address to mail VISA - SO MANY TYPO's & MISTAKES :(

05/08/07 - VISA YEAH!!!! FINALLY!

05/23/07 - Back to America - Well almost - Airlines messed up and sent daughters ticket to Chicago

05/30/07 - They finally made it!!! :)

07/03/07 - Green cards recieved

07/06/07 - Applied for SS card at local office, DS-230 application lost

2/19/2010 - Everything is great!!! We now live in South Carolina - Sonya has applied for her citizenship!! She attends USC for her BSN. Her mother has made 3 trips to US.
