Get ur son a USA passport and bring him for visits... Can you REALLY see yourself living happily ever after? If not, don't uproot both people to satisfy your "desire" just share custody and bring him for summers etc...

There is no requirement to be in love. You both must have the intent to marry within 90 days of her entry with the K-1 visa. You need to be willing and wanting to marry and make your marriage and family unit work.

A. You don't need to be in love. My wife didn't love me. She was a fraud. You could do the same, but it would be fraud. Or not. You could re-develop your relationship, as crappy as it is, spend several hundred on the visa process (what country?), and visit her and the kid a couple times. Basically, blowing a lot of dough to get your child here. Once she is here emotionally abuse her (i'm kidding but theoretically you could do it), and she can then get her green card for free via VAWA. Your risk though after marriage is she takes you to the cleaners which she probably will AND you'll lose custody. So, your best option is simply to go visit the child often and avoid the legal and immigration drama.

B. Submit proof the child is yours and see if he/she can travel to you which the mother likely won't allow unless you pay her off.

Your situation sucks. You can make it suck more with a fraudulent K-1.

Does the mother want to move to the US in the first place? If she's considering even that (big, huge life-change), maybe she's not that negative to try and make a family out of this unique situation. Maybe all this tension between the two parents is exactly because of the distance and the fact that they cannot have a normal family life. Just thinking...

One post has been removed as hearsay that recommends fraudulent paths. Another post, quoting the removed one, is returned to the thread with acceptable portion retained, as follows:

No. If love is fraud then it will not work. End of story.

You either commit or get out.

If the poster of the removed post can produce the direct verbiage, in context, directly from the attorney who allegedly provided the information, it might be permissible (this is not guaranteed). Otherwise, hearsay information recommending fraudulent or devious behavior is impermissible on VJ.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
