Hi, people! I'm fairly new here and I am in so much despair with my case. I hope you guys can enlighten me...

When I was under 21 years of age, around 17 years old, my mother filed a petition for me (F2A). It was approved when I was around 18 years of age and according to her I should have been there in 2012 but sadly she then found out that the man he married in the US did not process our papers that was mailed to them. I only found out about this last night :( is there any way my mom could retrieve the priority date in this as long as she still has the important details (i.e., case number, etc.)?

So my mom applied for another petition when I was 19 years old and it was approved on April 29, 2014 and the priority date was March 28, 2014. Sometime in October 2015, my PD became current but I was 22 years old by then. Then I found out my category was then changed to F2B. I asked my mother about this and she then told the lawyer she hired about it. We got no specific answers.

So, I was browsing through Google because I was so desperate for answers and then found out about CSPA. I just found out that CSPA requires two things: CSPA age under 21 years of age (I calculated mine using an online CSPA calculator I found online and the result was 20 years, 9 months and 20 days) and the one-year filing requirement since the PD became current. Actions that I have taken within that one-year period was seeking advices from the legal counsel my mom hired which I mentioned earlier and inquiries at USCIS regarding my case as I have been in so much loss as to where to proceed with my case. I could not understand a thing about the CSPA until just today that I bumped into this website that explained the law in details as much as I understand. Hence, my urgent need to seek assistance from you guys.

The PD became current in October 2015, and to this day, November 2015, that would be more than the one-year filing requirement. But I read cases that were allowed for certain circumstances the late filing of the visa. Please enlighten me on my case. I have been crying for nights already because of losing hope :( Imagine, there were nearly 2-3 chances of me being in the US with my mom but those chances were missed due to disappointing circumstances. :( Please help :(

When I enter my case number at CEAC it only says "At NVC" and when I enter my number at USCIS it says there, "Document returned to USCIS" :( what do they mean? :(

My mother petitioned my older brother when he was 19 years old and he was placed under the F2A category but due to the slow processing of NVC he turned 21. SOmetime earlier this year his case was converted from f2a to f2b and my mother requested a review by the NVC. AFter this his case was switched back to F2a. Today he received his interview letter and he still under the f2a category even though he is now 22. DO u think the consulate will deny him a visa because he aged out, even though NVC reviewed the case and switched him back to F2A? please reply! thank you

Hi, newbie here! Can anyone help with what to do?

My mom petitioned me together with my sister and brother on 2006.

Brother and mine = PD August 2006

Sister = PD September 2006

On October 2016, my sister already received her WL. while me and my brother still none.

We tried to email nvc and the couldn't find our (brother and i) case number.

Until now we still don't have a case number.

My question is, how long would it take to acquire the Case number?

(F2A) Spouses and Children of Permanent Residents

If the letter from the NVC or USCIS has him under F2A category, then he should be fine. Do you have a copy of the communication from NVC requesting the conversion from F2B back to F2A? That should suffice if questions are asked. It means he benefited from CSPA.

Opt out requests should be sent to USCIS only they can adjust you case category. You can email or call the office responsibly for your country

I- 130 .... sent USCIS August 4, 2010 - Approved at NVC Jan 2011 received approval letter with case number and Id number

Welcome Letter..... Received Feb 23, 2016

Selected agent...Feb 25, 2016

Paid AOS and Visa Application fees.......Feb 26, 2016 

Submitted supporting doc......Mar 20, 2016 ( would have done sooner but had to wait on petitioners tax docs)

Hi Khadija. How did you request opt-out? You could send a registered letter to the USCIS office responsible for your country, or send them an email.

I sent in mine on Nov. 7 via email and received a response by No. 15 by email. Their letter to me confirming my request was approved was delivered sometime last week.

You can always try calling NVC to check on your opt-out request.

Sorry one more thing to say my dad sponsor me so he meet with solicitor he said if my dad request for opt out it will be fine .do u think it's ok or as a benificiary I should also sent request latter .I'm confused can u please tell me ur opnion about it

Does he have the response from NVC, whether their email or letter response that the opt-out request was approved? Or that the beneficiary's eligibility will be considered under F2b?

Either the petitioner or beneficiary can request opt-out, you just need to provide a copy of the naturalization certificate as well as information about your case; if your father already requested, and it was approved, no need for you to do so again.

They usually send two: one that they received the opt out request and another that it has been approved. What's your PD? I'm not sure if you can call the USCIS office in Bangladesh to follow up, but wouldn't hurt to call NVC to find out if the opt-out request is noted on your case.
