I expect that the petitioner is this case is primary sponsor and is ready to sponsor the applicant . Right?

if the joint sponsor (required only if the petitioners income is less) withdraws , logically it shouldnt be a problem , but your friend needs to find another co-sponsor ASAP . and he/she can take the AoS (I 864) at the time of interview and explain the situation upon asked . As long as the new joint sponsor meets the requirements , it is fine.

The joint sponsor is my friend dad sister.they had some family misunderstanding and she just verbally said she was going to withdraw. They are now waiting to be informed by the NVC via their agent if the aunt has withdrawn or not.Let's just hope and pray she doesn't withdraw because they are so close ...their priority date is sometime in September 2009.

Do you know your friends' exact priority dates in August 2009? I'm referring to the ones that have received their interview letters for May.

If so, please, please, please, let us know.

Limenite22,

Please find attachment and check priority date.

Anjum,

The priority date in the attachment doesn't appear to be correct, by 12/8/2009 I'm guessing that it mean 12th August. In your footer timeline you mention NOA1 date as 2009-JUL-27, which one is correct priority date? The person I'm helping has a priority date of June 27 and got interview for May 6. She is under F2B and in India.

Though I'm not an attorney, I'll add my 2 cents for others who are asking when does NVC issues interview letter - if you call NVC they will tell you that you'll get interview letters only after your visa date becomes current. These dates become public when we see visa bulletin. NVC knows based on data received from embassies and USCIS and have calculations in place at-least 2 weeks before that. Since Anjum's child's PD is either 27th July or 12th Aug, I'm guessing the MAY visa bulletin that will be out in next 8 days, F2B is moving at-least 6-8 weeks i.e. priority date would be either August 1, 2009 or August 15, 2009.

Dear Lizzy2329,

The sponsor should have another joint sponsor in mind/ready in case the aunt goes through the withdrawal process which must be done in writing and submitted to the appropriate immigration entity.

What if the aunt doesn't go through the withdrawal process and the embassy interviewer asks the beneficiary for the joint sponsor's 2015 tax return copies?? Is the aunt going to be willing to give it to you guys?

PS: I was kind of in your situation so I have another joint sponsor willing to commit if necessary.

Anjum123,

Thank you for the quick reply!!!

This person, Nam Bâo An, in the F2B visa category, who has a priority date of August 12, 2009, has already received his interview letter, then, that means that the May 2016 visa bulletin will at least move to August 15, 2009. That's fantastic news!!

Thank you, Heavenly Father!

Sap283,

Anjum123's priority date is July 27, 2009 (F2B category) and received interview letter in the month of March.

Nam Bâo An's priority date is August 12, 2009 (F2B category) and received interview letter in the month of March. (See picture attached)

Alshah's priority date is June 24, 2009 (F2B category) and received interview letter in the month of March.

The person you are helping has a priority date of June 27, 2009 (F2B category) and received interview letter a few days ago.

The NVC sent interview letters to these 4 people at least one month before the new visa bulletin would show that their priority date is current.

That's just awesome because, from this, we can assume that the F2B visa category on the May 2016 visa bulletin will move to August 15, 2009, at least.

Lizzy2329, from this, you can assume (as a general rule) that the NVC will send you your interview letter about one month before your priority date shows as current on the new visa bulletin. I hope it makes a little more sense now.

Limenita22

PS: I'm no lawyer either. I make assumptions based on the very limited knowledge acquired over the past years.

I have not notified NVC of my naturalization directly. I have another case for my Husband and I submitted it after i become citizen. So NVC learned about my naturalization from the second application. They put both cases under review for 45 days and as result they changed my daughters case to F1.

I have sent request to out out via email and certified mail to NVC on Mar 21 2016. No info/response so far and the application for My daughter is still NOT accessible online.

I am planning to start calling to NVC this week. On another hand my husbands application is released and I have received welcome letter.

Also i reached out to the Moscow USCIS ( since this seems to be European DHS office that have jurisdiction over UKRAINE) via email to see if they are correct office to provide the DHS approval for Opt out.

At first they responded next day stating that they only process I-130 for the Residents of Russia - i guess standard response..

In next email i responded and asked with details that i am looking to get OPT OUT approval and not to file i-130, referred to the law and memorandum, etc - no response for a week - i guess they do not know what to do with this request..

Hi,

Send request to the USCIS of Detroit,MI , they have responded to me, they gave us Opt-Out approval letter.

I think you misunderstood the thing that is not my Priority date.My priority Date is "27th July 2009" and attachment is for my friend priority date that indicates that visa bulletin of upcoming month will exceed approximately 2 months.
