Hi, I'm trying to understand how everything works. My father petitioned me and my sister (plus my 2 kids) when he was a permanent resident. Recently, oct '15 he has his oath-taking as a US citizen. He didnt update his status yet on the petition as he is currently on vacation and will update it once he goes back to US. The only info I know is that he filed the petition 12/20/10. And as far as I know, since my sister and I are 21 years over when he filed the petition, so it would take 10 years.. Can anyone please help me understand what and where should I check the status of my petition? I saw the Visa bulletin and if I am not mistaken, it says that the Visas right now that are being processed are year 2005 petitioners. So does this mean I still need to wait for 5 more years? We are currently filed under F2B. Please, please. I am desperate to know some answers, been wanting to spend time with my parents living in US since theyre getting older. Thank you, in advance.

sorry charmedone,

f2b just for unmarried sons and daughters over 21 years. And it is only available for green card holder.

once the applicant get married the application is revoked. may be your sister or brother is still good to go if not married .he or she may even benefit from the naturalization of your father by switching the category from f2b to f1and keep the same priority date.

check the visa bulletin to see the processing time for each category.

your father can apply for you now under f3 .it is a long journey ahead ..........

I have 2 kids with me, but I am still not married. :) do you know how long does it take? I think it's slower if Im from Philippines.

yes indeed long journey if from Phillipines. For the last 5 years the vb went from August 1999 to mars 2005 means 5years and 7 months.

don t let your father update your status to f1 at least for now.may be down the road if things changed in f1.

f2b is ahead by almost one year now.

hopefully for you another 5 years or less .......

good luck

The Philippines is a lengthier process than the rest of the world.

To my understanding, if your father hasn't submitted his naturalization certificate, you will remain in the F2B category. If he already has, or if NVC has updated his status and thereby your category, you can request an Opt-Out letter to remain in the F2B category. Of course you will have to remain unmarried, you can add your children to the petition, submitting petitions for them as well.

Your priority date is 20Dec10, they're currently processing petitions earlier than March 2005 for F2B.

First step is to find out your case number, you can check USCIS online for status. If its been approved, its been moved to NVC.

Next, your father needs to update his immigrant status, you will need to get an Opt-Out letter to remain in F2b since that currently the fastest moving category.

Best bet, is to make what phone calls you can and then contact an immigration attorney for more help.

Thank you :) Will ask my dad to send the case number to me when they get back. May I ask please what are the calls and attorney for? Like follow up the visa processing? Will the latter fasten the processing? Will it cost me to get an attorney for this? Im really sorry for all the questions Maam, i am trying to get all the info I can since my parents have little patience in reading info like this, so I just tell them all this.
