So, this new bulletin release is kind of confusing. Two new charts, for regular adjustment and another for adjustment of status that jumps all the way to 01JUL2010. Wow.

Question for F2B applicants, my aunt is saying that she had my cousin send an e-mail to NVC asking that they "rush" her brother's petition since the mother hasn't seen him in a long time and apparently, they sent an e-mail back saying that they will send a welcome letter and she has to pay the AOS fee ($120) and complete the COA.

His PD is May 2010. Now, I just want to know if anyone else has received a welcome letter recently and what their PD is since I think it's just that his case was next to be processed at NVC anyways and it wasn't her e-mail that triggered it. Thanks!

There is a new policy starting October 2016. His PD allows him to start the process to apply for an immigration visa.

The "rush" request had nothing to do with getting the case moving. It's just coincidental.

Thanks for the reply! Now, even though his process has been started it means he'll still have to wait for his priority date to become current before he can be issued a visa, right? The current priority date is Jan 2009 so even if he has a case complete date say in about 6 months, he'll still need to wait until his PD is current before he is given an interview date?

THOSE ABROAD - nothing really changes.

1. AOS does not apply to those abroad.

2. For those abroad, the "Dates for Filing Application" allows for the filing of the paperwork towards an immigration visa. The PD still needs to be current under the "Application Final Action Dates" in order to get an immigration visa.

ONLY FOR THOSE LEGALLY IN THE US ON A NON-IMMIGRANT BASIS

1. Can file for AOS when the PD is before the dates listed in the "Dates for Filing Application"

2. Must wait for PD to be current in the "Application Final Action Dates" in order for case to be adjudicated for a green card.

3. With AOS, can file for EAD and AP until AOS case is determined.

4. BE WARNED. Immigration intent may be an issue if a family preference category beneficiary uses a non-immigrant visa or the VWP to enter the US with the intent to immigrate. Matter of Battista and Matter of Cavazos may not apply.

USCIS announced these coming changes yesterday, Sept. 9, 2015.

USCIS is still working on the revised procedures, so it may not be possible to file on Oct 1, 2015. He may have to wait until the system is implemented to file his paperwork.

Ahh, I see. Yes, in the e-mail they sent my cousin, they supposedly told her to wait for the welcome letter with the case number and invoice number. I'm sure they'll probably send it when the procedures are finally in place.
