Good job Puru!! Hope this is encouragement for all those in a similar situation. As I have learnt over these past several months, there is lack of coordination among the various immigration offices and even if one reads and follows the instructions to the T, there is still something that is left out, maybe because of the overwhelming number of cases, categories and compliance requirements.

My son will be here this Sunday morning, his flight lands at 7.30 am. Im thrilled but my heart goes out to all those who face the immigration tests. It certainly is an arduous journey.

The part 5 would not be applicable in your case Sap, as the others are included only if they are earning members. That is just additional financial security, just like a joint sponsor, but these people are residing with the sponsor/petitioner so the household income is enhanced.

I think tax transcripts are more than enough. With those, they are able to get all other info online. I sent only tax transcripts.

Did you make copies of the transcripts that you received from IRS or submitted the original ones you received? I think you are supposed to send original signed AOS and bring the copy of that AOS at the time of interview, am I correct?

Yes thats correct! copy of AOS for interview, and I submitted original tax transcripts. Thats an important document, so keep some copies for yourself.

Thanks chubbs...I am planning to submit copies of the transcripts for the person I am helping. The reason is that they have 2 petitions and both requires separate affidavit of support.

On DS-260, what would you answer to : Q.Do you have documentation to establish that you have received vaccinations in accordance with U.S. law? Yes No...when you select NO(obviously in India people don't keep vaccination record) it asks that explain?

Sap, I did have a few vaccination records, but I just answered "NO" and mentioned that we would take all vaccinations to comply. I asked my son to go ahead and take the required vaccinations as prescribed by US authorities.

I said NO to vaccinations.

Explanation: I will go through the medical soon.

In fact, they gave me 3 shots during the medical appointment. So, just mark No and proceed ahead with valid explanation.

I have just received a phone call from USCIS New Delhi Embassy. She said that my Approval letter has been issued and they will mail me soon but I have told her that I will personally come to pick my Approval Notice :joy::joy:

Hi Everyone,

A quick update ! FINALLY I HAVE RECEIVED THE OPT-OUT LETTER FROM USCIS.

You guys can't believe how relieved I was when I got that phone call and then finally seeing that email with the attachment. The letter clearly states that they have approved my request to opt-out under Section 6 of CSPA and Section 204(K) of the Immigration and Nationality Act.

So here is the resolution for those who seek this conversion to the big mystery that I have been trying to unravel since Nov 2014:

1. The Approval Letter can only be issued by USCIS Field Office where the beneficiary is residing

2. NVC needs to know about this Opt-Out so they can start the processing. However the authority to approve this opt-out is only with Department of Homeland Security (which is USCIS)

3. The consulate (Department of State) may not ask for this Approval letter depending on the country, but this is a HUGE RISK. Every beneficiary in this situation is advised to get this letter.

How do I get it:

1. If you feel that you will benefit from this opt-out provision, please contact NVC first.

2. They will start the processing of this case under F2B category.

3. They will notify by mail about this and that letter will also indicate that you must get approval from DHS (which is USCIS)

4. Then the beneficiary should make a written request to the USCIS Field Office (based on his residence) indicating that he/she wants to opt-out of this conversion under Section 6 of CSPA and Section 204(k) of INA.

Include the following documents for reference in your written request:

- Copy of I797 Approval Notice

- Copy of Naturalization of Petitioner

- Letter from NVC approving the opt-out and requesting to get approval from DHS

- USCIS Memorandum indicating how the USCIS Field office should proceed for such a request at:

Send it (suggested via email and regular mail and if possible in person) to the Field Office as displayed here:

I know buddy ! Without this support, I really wouldn't have been able to get to this stage ! Last week was hellish for us, as everything stalled and the only thing mattered to our entire family was this piece of paper !

Indeed today was the best day. Now I am jus hoping and praying that we don't have to wait too much for the interview call again.

The Officer in charge actually did comment that this was the first case in India where a immigrant visa was put on hold for this issue. So yes, ours was the first besides Phillipines where something like this happened !

Good luck to everyone else on this matter.. Now that the office knows what to do, I am sure it will all work out for those in this situation !!

According to NVC page instructions,
After you collect your Affidavit of Support form(s) and financial evidence in Step 4, and supporting documents in Step 5, you must submit all of your forms, financial evidence, and photocopies of your original civil documents in ONE package to the NVC.
If neither Method 1: Email processing nor Method 2: Choice of processing applies to your case, mail your financial forms and evidence, supporting documents, translations, and photocopies, with the Document Cover Sheet included with your NVC Welcome Letter, to the following address:
National Visa Center
Attn: DR
31 Rochester Ave. Suite 100
Portsmouth, NH 03801-2914
I see that puru and chubbs have submitted AOS documents 1st and then Civil documents. Also, the coverpage I have got says ATTN: CMR AOS for AOS coversheet and ATTN: CMR for CIVIL douments coversheet. Address on NVC page says ATTN: DR, so my question is :
Does it delay application if you send AOS with financial documents 1st and then send Civil Documents?

You can send both packages combined.

or

You can send Financial package first. Civil package later.

or

It depends upon the availability of documents. But, you need to send all the required documents in packages instructed by NVC.

I sent Civil later bcoz my PPC wasnt issued, whereas my father obtained all the required documents and I wasnt agree to send my Civil package to my father's residence which could take a week or so and then my father send both packages combined to NVC. This is a long process.

Note:

1.Make sure the Bar Code Sheet is correct because there are two different Bar Code Sheets for both packages, follow the order instructed by NVC.

2. Send all the photocopies of all documents in both packages except original signed Affidavit of Support. But, applicant must need to carry all original documents during the interview.

Thanks puru for detailed response. In what order it should be sent? The barcoded checklist NVC sent is kind of confusing.

On a side note - does USCIS approval notice(NOA2) ever needed?
