Hope your case is going well. My sister who is in USA on F1 (student) and petitioned by my father PR, good news is that now her I-130 got approved as she got an email from NVC.

 

1. Can she start process as per given in NVC link to pay fees of AOS, submit documents etc? Or should she has to wait for her PD to be current? Her PD is April 2017.

2. Is there any adverse effect if she submit this before PD gets current?

If NVC asks you to pay fees and documents, then you do as usual. There is no adverse effect. In fact in the good old days of 3 years ago lol, NVC, interview and other formalities were usually done before priority date becoming current, so you don't wait a single day after you are eligible for visa. 

 

Now you may be eligible but your petition hasn't even been approved in 5-6 years,  let alone NVC or interview. Things have really messed up the last few years. 

 

Now USCIS is out of money and they almost furloughed 2/3 of the employees. 

 

Now to elaborate your question, you can't do anything unless they want you to. So the link to pay visa fees and documents will only work if NVC allows it. So, go ahead as usual. 

 

Now how long it took your petition to get approved? Which USCIS centre and your country?

NVC is irrelevant if she is in US and plans to do adjustment of status. The reason NVC probably sent this email is because on I-130 it was probably mentioned that she will do consular processing abroad instead of AOS in US. You must contact NVC and let them know that beneficiary is inside US and plans to do AOS, NVC will send approved petition back to USCIS. USCIS handles AOS, not NVC. NVC only handles those who are abroad.

Thanks friend. You are right, there is one place in NVC FAQs it is mentioned to contact them and let them know if

it is AOS so they hold and USCIS will adjudicate the AOS

However, I double checked on i130 there is no place to differentiate the choice but in cover letter she mentioned that she is attaching current visa. Hope it won’t effect the process time.

My sis is in USA on F1 student visa from India and there is no way she can go to attend NVC visa interview in Mumbai as mentioned in their email. She has to do AOS and that’s authority is with USCIS unless you have any concrete information.

If you're doing AOS, then you follow the advice given above. My suggestion was for overseas consular processing by NVC.

Hi! My PD just got current this September 2020 Visa Bulletin. I'm under F2B. I already have my case number and Invoice ID when I called NVC. Still waiting for my Welcome Letter to arrive. NVC told me I have to wait about 6 weeks for my welcome letter because they are converting each case into electronic processing.

 

I was wondering if anyone has a similar case. Please kindly comment how long you've waited for your welcome letter after your PD became current in Chart B. Thank you

 

I've heard from other F2B who already got their WL and with same month of PD as I am, they were able to start the process even without the WL. It just needs to be activated. I wanted to know if someone has the same experience related to this. I would appreciate your comments. Thank you.

My petitioned relative is also from the Philippines, F2B, priority date is September 2015, and I think it is still not current in the visa bulletin.  I-130 is already approved early August 2020 and together with that email is an NVC number and Invoice ID, I don't know if this is the welcome letter that they were talking about in this forum, last week the CEAC online account allowed us to pay the AOS and IV fees online.  Are you in this process where you had paid your processing fees already?  I am asking because you said that your priority date is already current and ours is still in the waiting stage...

Hi. Thank you for your response. I am supposed to login but when I called NVC, they told me to wait 6 weeks because they are converting each case to electronic processing. So sorry, Maybe you need to be patient for now and I think there is some glitch in the conversion to the electronic system, btw what is your priority date?
