Hi all..

I need an advice from you..

After inquiring of my i-130 application status from USCIS Vermont, I have been asked to submit the birth certificate or some secondary evidence. The birth certificate doesn't carry my name and hence couldn't be used to establish my relationship with the sponsor(mother). 

Obtaining birth certificate/ getting it rectified is a complex procedure in my country. What all secondary evidence I can submit? Can I submit passport copy?

Is this your mom?

 

 

Even though it's a complex procedure to get your birth certificate fixed, it's not impossible.  You need to comply with what is required.  

 

Your passport contains no proof of parentage so you can not use it to show who's your mom.

F2B category and she has applied for her citizenship. 

Then you know what you need to do.  Get your birth certificate corrected or a certificate of non-availability from the local authorities in India.  Nothing else will satisfy the requirement.  Your mom is getting a NOID, so you need to take this seriously.  You are risking your chance to immigrate by trying to get a work around to a requirement.  DNA and secondary evidence will not be accepted in lieu of a correct birth certificate or a certificate of non-availability.

Thanks Aaron for the valuable info.

The USCIS letter stated that a secondary evidence can be submitted in lieu of birth certificate. Since there is a time limit of 60 days, I was bit worried. So I wanted to know of other options (secondary evidence) I can submit. 

But as stated by you clearly, there is no other way around, I won't waste much of my energy on other options.

Carefully read what NikLR posted to your mom.

 

In order to use secondary evidence, you need a certificate of non-availability.  There are no exceptions.

NOA1/PD 11/12/2013

..and still waiting

 

Does it expedite if I become a citizen? Currently an LPR of 9yrs and about to file renewal of green card. Any help I will appreciate. Thank you.

Hi Lerma..

You should wait till your priority date(PD) becomes current. You can check it out from below link:

I am assuming your country of origin is Phillipines, as mentionion in your profile.

Presently, according to the November Visa bulletin, the PD for Phillipines country is Sept/October2009. My suggestion for you is to apply for citizenship (F1). It won't expedite the process as PD for F1 and F2B category are neck to neck. But it will surely cushion you from any changes in immigration law.

 

Can understand the ordeal associated with the word 'wait' but....

Hello guys!! I need your help. I might be starting my NVC processing soon but there's one little issue bothering me.  The place of birth in my passport is different from the one on my birth certificate, Although it's same country but it's a different state. Does it really matter since its the same country? Or do I have to make a correction with a new birth certificate knowing I have used the current birth certificate for uscis processing?
