mmigrants applying for US visas will be denied entry into the country unless they can prove they can afford health care within 30 days of entering or can’t pay for it themselves, according to a proclamation signed by President Trump.

The new rule, which comes into force on 3 November, will be applied to people seeking immigrant visas, not those in the US already. It does not apply to those seeking asylum seekers, refugees or children.

But it would apply to the spouses and parents of US citizens. That could have an impact on families who are trying to bring their parents to the US.

The proclamation said immigrants will be barred from entering the country unless they are to be covered by health insurance within 30 days of entering or have enough financial resources to pay for any medical costs.

The Trump administration is trying to move away from a family-based immigration system and into a merit-based system, and Friday’s proclamation is another effort to limit immigrant access to public programs.

that means your sponsor has to cover you with a health insurance ...this is serious!!  But we will jump that cross that bridge

Will this new rule affect us , the f2B applicants or immigrants??  Since its written “But it would apply to the spouses and Parents of the US Citizens”

Hi. Good day. I have a question for those in F2B visa category. My father, the one who petitioned for me has a critical illness and my brother and I would like to visit him in the US. Is there any way that I can be granted with a tourist visa to visit my father? I've tried applying before but I get denied. I also asked some agencies here that if you have a pending petition, you cannot avail of a tourist visa. If anyone here know how to deal with this kind of situation, kindly let me know. Thank you.

The agency is wrong that you CAN'T receive a tourist visa, however, it is more difficult for those with pending immigrant petitions to overcome the presumption of immigrant intent that one needs to do before being granted a tourist visa. The fact that you also have a denial will not act in your favor. What are your current ties to your home country? Do you have a job, house, etc? What were the reasons your previous B2 was denied? Have your circumstances changed?

Just remember when the CO is adjudicating your case, they are more interested in the reasons that you will return home, rather than the reasons you want to go to the US

That's what I was thinking too. During interview, they don't ask much. As far as I know, they already know the decision whether to approve a visa or not after sending the application. I tried last year saying I wanted to visit my father who has cancer. But still, they denied the application. I have heard of a family who applied for a tourist visa to visit a family member in the US with critical illness. One of them has pending petition too and was granted with a tourist visa. Now, that is what I am being curious about.

It really doesn't matter that someone else got a visa in a potentially similar circumstance. Every petition is evaluated individually. You can try again if you want to and pay the $160 but chances are you wont get approved
