I'm hoping if anyone here can help me. My brother and I are F2B but my mother became a US citizen so we are now automatically bumped to F1. My mom filed to opt-out from F1 to F2B because F2B was moving faster. But I still haven't done that locally here in the Philippines.

 

Our priority date is July 5 2007. The current date for the Philippines in May 2017 is 22JUL07(F2B) 08SEP07 (F1). Final action dates are 01AUG06 (F2B) and 01FEB06 (F1).

 

My question is - do I still need to submit requirements for opt-out from F1 to F2B even though they are both current next month?

Have you been approved for opt-out to F2B? If so, then yes, you should bring with yourself an approval letter and continue as F2B.

My mom can't find her naturalization certificate for me to send through mail so I haven't mailed the requirements on our side. But already sent a letter back in 2014 for opt-out on her side.

 

Will this affect our petition? Should we continue to opt-out of F1 or should we just stay in F1?

 

Also anyone know how long will it take to opt-out once we mail to USCIS?

I highly advise she request a copy of her naturalization certificate. I requested opt-out to remain in F2b (wish I hadn't since F1 is now moving faster than F2b) and was told if there wasn't a copy of that on file, the opt-out might not be approved. I had sent in the copy of the certificate when I submitted the documents required for the I-864 (affidavit of support from my petitioner) so they had that on file.

 

I do regret the opt-out because my PD would be 2 months current had I stayed in F1. Opt-out usually takes a a few days to a week to respond - its to the USCIS with jurisdiction over your country. They respond by email and then send physical letter within 2 weeks.

 

edited: I saw earlier post. Are you already in the US and filing AoS? The dates you provided are for Table 2. Your PD won't be current until Table 1 reaches a date past 05JUL2017.

I'm lost, what am I supposed to do for the 2nd table?

Table A.  FINAL ACTION DATES FOR FAMILY-SPONSORED REFERENCE CASES 

Your PD will be current when your category reaches a date past the one noted. For eg, my PD is 21OCT2010, I won't be current until the date in Table A is say 22OCT2010, when a visa number is available for my category.

Have I understood you right, that you didn't receive an approval letter for opt-out to F2B? Then you should continue your case process as F1. Stay in this category, as it moves faster now. 

2nd chart shows that you'll get your Welcome letter soon and your case will be opened for further processing.

yes no approval letter yet so I guess we're still in F2B. But the final dates seems to be moving more for the F2B though.

 

Sorry can anyone clarify as to what the table 2 i.e. (DATES FOR FILING FAMILY-SPONSORED VISA APPLICATIONS) means?

I think, that you should update your case with NVC, send a photocopy of your mom's US passport and you'll be confirmed as F1.

Once again, 2nd table means, that you'll receive a WL from NVC, that you'll be able to submit your supporting and financial docs for reviewing, but you'll get your Interview letter only when your Priority date will become current and this will show chart No.1.

That looks like a generic response that they send out once they've received your application and its still being reviewed.

You say your PD is current? Aside from calling NVC again in a few days, your best bet is to wait until they get around to completing your case for review and schedule your interview. 

 

I hope someone has better info for you. Do one thing tho, see if you can do a timeline on your own, that way you make sure you've sent in all required documents and all your info is recent. That way, when they do contact you, you're ready. Good luck.

Pray for us  every one . I'm so worried like what is happening . Last year they take year keep saying in rivew then decembr said we lost ur file then found ino January we sent all documents now keep saying in rivew😥

It's happening things like that to some cases, that they request some documents, which were already submitted. Last year the review after checklist took 30 days, now it's 12 weeks and more. To make a timeline is a good idea.

I'm wondering why you never call NVC to ask when your case will be completed, that they would just confirm, that it's out of their timeframe and maybe will tell you something more. I was calling once in a month to get an idea what's going on.

I did end of last month nvc said it's on review still. They said wait when it's finish we willl send u latter or email. I will call next week again. Last week I called then I thought may be I will get lal later or email soon. Pray for me I will make next week again hoping the best .

Ok, make notes each time when you contact NVC. So next week it'll be 14th week of waiting? Well, you need to be patient, but keep the pulse.
