So today my husband and i decided to start making the paperwok for the AOS.

First stop was to the Social Security office........

They couldn't change my name because they said that my name should be changed first on my i-94 ..... I even told the lady that in their same page they say that i can show my unexpired i-94 and it will be fine (also with my marriage certificate) and she told me NO..... i have no idea what to do now.

Then we went to the bank to change my name on my credit and debit card but for that they need an ID

We are lost ...... :help:

Would it be ok to send my social security, credit and debit card with my single last name for the AOS?

We were told the same thing by Social Security and the military. Once we get the EAD we will be able to change the name on those documents. Let's see what happens. They said the names have to match in DHS, so once the AOS is in process this should fix that problem.

Yes, all the AOS package was in the single last name. Our bank, USAA, allowed me to convert to joint account on checking/savings and credit card. I had to send the marriage certificate as well as an IRS Form for foreign aliens , then they changed the accounts. The bank supplied the form they needed. I don't remember the form number. Hope this all helps.

Yes, all the AOS package was in the single last name. Our bank, USAA, allowed me to convert to joint account on checking/savings and credit card. I had to send the marriage certificate as well as an IRS Form for foreign aliens , then they changed the accounts. The bank supplied the form they needed. I don't remember the form number. Fill out all the AOS forms in your married name. Not sure what you need a credit/debit card for with AOS. Also, no need to send a copy of the SSN, just list the number on the forms where it asks. When you get the EAD/AP or your green card in your married name, then go to the SSA and get the name changed on the SSN.

I was able to change my name on my social security card before I applied to adjust status and before I received the EAD. I only did this for convenience - as others have said, my understanding is that you don't need to do so and can apply for AOS in your married name regardless.

I think perhaps the difference was that I first changed it in my home country (Australia - two step process - first, change it with the Registry of Births, Deaths and Marriage, then after receiving an updated birth certificate with my new name, I got a new Australian passport in my married name). That way I had a passport to show the social security office. But this would obviously add some length to your timeline, depending on how long your home country takes to issue new passports (I assume it's not a good idea to get a new passport in the middle of the AOS process?)

Also, for what it's worth, the DMV I went to gave me a license in my new name on presentation of the marriage certificate (and nothing else). My bank didn't ask for any proof of the name change at all (they've known me and my husband for awhile).

That's odd. When I went in to change my name. They took the marriage certificate. I94 , passport and changed it just like that. In and out in 10 mins.

No you have a well trained SSA person and the OP had an untrained SSA person. https://secure.ssa.gov/apps10/poms.nsf/lnx/0110212001 is what is considered a legal name by SSA. If you want to search the VJ site for the author I'M GONE and name change you will find that the SSA is to accept the Marriage Certificate as an official name change document and since they do not consider the middle name as part of the legal name, you should be able to move your maiden name to your middle name and use your husband's last name as your last name.

Another thing he recommends is to e-mail the SSA.

Like, we are no illegal immigrants, but we are not quite legal yet... We are in some sort of limbo in between xD? Of course, this only applies for people adjusting from a k-1 with an expired i-94 (or about to expire).

I filled ALL my forms for AOS with my married name. I mean ... all the prove you need to change your name is your marriage certificate. As long as you submit it with AOS (which of course is a must) you should be fine. I have also been added to my husbands bank accounts with my married name just by showing the marriage certificate and all my other documents in my maiden name.

But I guess you could do it both ways?

It has to do with the fact that SS has to match the name that is in the DHS data base, so when we apply for AOS it changes. Once you receive the EAD you can go to SS and change your name.

This is not true. I changed my name using my marriage certificate before I even filed AOS.

Well it is TRUE for my SS Office. I asked about it when we first got the SS card and that was their answer. You CANNOT force them to do it.
