my husband receive today the DS-260, we are really nervous because he was deported 12 years ago, he use too had a green card but the judge remove him and deported him for 10 years, now 10 years has pass, our lawyer its saying we are going in the correct path, and when he get the interview the agent will give him a paper to apply for a waiver or may denied his application. my question is, if someone has been in this situation? Or what can any one advise.

I have received a call from my lawyer today and he said that we need to apply for Ds-260 and I-601, but the strange thing is that INS won't what me to file by mail the I-601 we need to take the form when we get the interview right there they will ask me for the I601 and pay the 670 dollars, I have been reading here that first you mail your 601 and wait for 6 or more months before you get the interview, my lawyer said the my husband case has been odd from the beginning Because INS started going not normal process, but my lawyer said we are going in the correct direction.

Just wonder who else has got something likes this.

I will try to keep everyone up to date on this, my interview will be in Cd Juarez around December of this year.

U will petition I130 by your atty (the one U have don't know

there's been changes for 2 yrs?) The waiver have to be mailed

to the lockbox in PH & sent to Neb. for decision , it can take

4-12 mhs. The atty will prepare everything but U have to give

him evidences, disposition on hubbys case. hardship letter from

U & a brief written by atty outlining everything...hardship can only

be on U...he'll get interviewed and denied the visa then given

approval letter to file waiver at lockbox, He will get a checklist of

what he should have at interview. DS 260 comes right b4 interview

all answers must be honest.

your hardships is going to have to be very strong ex GC holders

are not approved easily, with a poor waiver packet or arguments in

attys brief , so hopefully he has exp. with waivers of ex GC holders

I'd suggest U go to immigrate2US.net and read up on what hardships

U see here that may also apply to U....waivers are $585 each a

draft or MO should be on top of packet for that amount, then a G28

from your atty, make sure U signed it too and he also puts your email

address on the I601 form when its filled in. I'd suggest U get a copy

of every piece of paper from your atty too, he can scan & email to U.

good luck Hope U R not using a notorio...its doable with someone

knowlegable

Jawaree, thank you for your replay, its a lawyer and he login into my husband case and said that INS has requested not to mail the waver, that my husband needs to take it with him and the money to pay the waiver there, thats what my case says, and you right checking the paper I got from INS I-130 and need to pay 88 USD, he also give me a paper to anwser some questions and he will prepare the waiver, but will prepare a good hardship case,
