Advice Please!

Hello- We got the conditional GC in December 2012. So 90 days before expiration would be September 2014. I am gathering all the evidence ahead of time to make sure the process is stress free because we are expecting a baby girl in October 2014 and getting this done in a timely manner will avoid a lot of headaches. We have all the evidence suggested for the I-751.

Now, my husband initially came to the US as a student with F1 Visa, which unfortunately got expired due to not being able to pay for school so obviously he was not going to school anymore. Once his status was reestablish as GC holder he started looking for jobs. He applied at tons of places, went for interviews yet he was not being chosen. Perhaps his lack of work experience didn't help. Due to this we decided for him to go back to school. Completing his degree is important to us. He got accepted at the university he wanted which is 2.5 hours away from home. To get a scholarship he had to accept living at the dorms. We considered for both of us to move there yet I had to get a job there and I was and still working at a good place (we depend on one income and financial aid has helped). So starting from zero since his program lasts just 12 months, made us decide for me to stay at home and him continue there.

We share the address, our rental agreement has both names. His school always uses our address to mail him official documents. We see each other at every break he has which is once a month or every two weeks. He comes home when he has longer breaks, I go stay there with him. We have evidence of traveling together to see my family, his family.

What other evidence besides pictures and receipts of my stays and his visits could I add to explain the period where we were not physically in the same address even though our rental agreement has both of our names??

Note: He will be physically living at our address by the time we submit our I-751.

Any of the official school documents would explain his enrollment and attendance there. He could get a letter from the registrar's office confirming his attendance. It is quite common for spouses to live in different places due to work or school. As long as you explain everything in your cover letter, you should be fine. (I know it can be nerve wracking to have Jon-ideal situations). Good luck!

Oops...that should read "non-ideal situations".

Yes, you should be fine. You both have a legitimate reason to live apart and evidence of visiting each other. I've read some stories with some pretty frivolous reasons that are destined for a RFE. It's good that you're thinking of covering all your bases!
