Hi Guys and thanks in advance.

My fiancée will be coming in shorty since she got her K1 visa issued. She has a mother in Baja California, who is married (not to her father). Anyways, my further mother in law wants to come to the wedding. My understanding is that B1 visa is the route to go.

She has the following (from what I am told):

1) Proof that she has a job,

2) that she owns a home in mexico (different where she currently resides in Mexico).

3) Proof that she has a daughter, with kids, in Baja.

She has no checking account, Her new husband is a US citizen that lives with her in Mexico, but does not want to give any of his info, SS, Passport #, Citizen certificate number, etc, out of fear that "he may be forced to fix her papers" I know it is dumb but what can you do. The home that she resides in is her husband's and he does not want to give any paperwork on her. Also, she used to have a tourist VISA about many years ago and was cancelled 12 years ago because she did not have correct paperwork.

I will prepare a declaration of support so she can take for the interview, but from understanding decisions are made usually by looking at DS 160. Any tips at filling out DS 160 so I can make sure that it gets across that she will return to Mexico (truthfully of course).

Any tips? Any advice? Any thoughts?

Best of luck but a declaration of support from you is next to useless and could very well have a negative impact on her application.

You mentioned she had a tourist visa cancelled, that could be a very serious point if it involved misrepresentation.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

I don't think it got cancelled for misrepresentation. She told me it was cancelled 12 years ago because she went on for additional paperwork that she did not have. I think may have been to renew.

Whe I saw fiancee's old passport it said cancelled I am sure her mother's says cancelled as well.

Oh and my future mother in law is 45 years old. If it matters.

Probably not in the end that relevant but the Visa would only have been cancelled for a reason.

And it a B2.

I am pretty sure she will know.

There is no harm in applying, only the application fee at risk.

I thought she was not living in the house, the US Husband would be a negative.
