If anyone has traveled to the US while their visa (applies to K-3 and IR/1 CR/1) application is pending please post, suggested format:

I travelled several times while my visa application was pending....had no problems and was never asked to provide any info re ties to Australia.

Probably a good thing because I didn't have any evidence.....that was before I found this site. ;)

Feb 04...... I 130 filed......................approved August 04

March 04... I 129F filed....................approved October 04

August 04...I 130 for children filed....approved September 04

Interview: Jan 19 2005 in Sydney

Leave for New Hampshire 27 January 05

We are Home!!!!! :o)

AOS timeline....round 1

2/16/05 I-765 mailed to Chicago

5/24/05 EAD approved

7/11/05 Started work!!

AOS....round 2 (to finally finish things off)

10/25/06 NOA1 for AOS/EAD

11/16/06 Transferred to CSC

11/17/06 Biometrics appt

11/27/06 Touched "Case now pending at CSC"

1/12/07 EAD "touched"

1/16/07 EAD "touched"

1/17/07 EAD approved "Card production Ordered"

1/20/07 I 485 "touched"

1/22/07 EAD card received

6/13/07 Transferred back to Missouri....grrrrrrr

7/23/07 Interview date! FINALLY!

7/23/07 AOS APPROVED!!! :o) 10 yr Greencard I 551 stamp in passport.

7/28/07 Welcome letter received

7/28/07 Card production ordered.

8/1/07 Approval notice senT

8/3/07 Greencards received in mail!

I did, but I was a K1 so not pertinant.

But why do you want this info? If it is to wwork out whether you will be succesful you are missing out key questions.

edited to say.....I came in under the VWP....and my POE was LAX everytime.

I don't understand, please explain...

In a few cases people have been turned away when trying to visit their spouse during the visa application process. The probability of entry while applying for an immigration visa will help us decide K3 vs. CR-1

In a few cases people have been turned away when trying to visit their spouse during the visa application process. The probability of entry while applying for an immigration visa will help us decide K3 vs. CR-1

There are many many factors that govern the success or otherwise of an entry, my guess the biggest one is pure luck.

Having a CR1 or a K3 in process would to my mind make no difference or be so low as to be irrelevant.

Maybe ignorance isbliss....glad I didn't know all that when I was coming in and out of the country.

I think it is a ####### shoot.....I wouldn't let it influence the visa I applied for.

Bring the evidence you think you need when attempting to enter the US for a visit.....but be aware that you may be denied entry.

What else can you do?

K-3 is a non-immigrant visa, cr-1 is one of it...at the poe, of what people experienced and i witnessed there..is either maybe some officers ignoere what's all about the visas...or the customer lies...never ever hide the truth...this is all it has to be known..in my opinion...we have not to ignore that lol...and bring ties to the original country...!!

CR-1, VT- Canada

I-130:

25 Aug 06 - Sent I-130 (a Friday)

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.

I've travelled to the US a few times during the CR-1 process, most recently would be May 06 though. At which point I was waiting on the NVC to do their stuff. I entered through Atlanta and got asked a few questions about being married to a US citizen etc but I just told the truth, I had no intention of staying and certainly wouldn't have spent as much money as I have on the forms and fees if I was going to just hop on a plane and enter the country illegally. I guess having several visits on my passport helps though as they show that I always go back to the UK afterwards.

I have entered the US five times in the last 12 months under the Visa Waiver Programme and I've never even been asked about a pending visa application.

I've entered in Miami, NYC, Los Angeles and Houston all without so much as a raised eyebrow.

Each time however I have carried documentation supporting my application as well as evidence that I plan to return home, i.e. bank accounts, mortgage statements etc.

Don't hide anything but I wouldn't mention in unless they ask.

01-01-2002 - Moved to NYC on J-1 Student Visa.

30-10-2002 - Met Katie in NYC.

01-02-2003 - I return to Scotland.

2002 /2004 - Back and forth UK/USA (many times!)

30-10-2004 - Proposed to Katie. YES!!!

03-02-2005 - Married in Glasgow.

01-03-2005 - Katie returns to US to file UK visa application.

29-03-2005 - UK visa issued!!

06-04-2005 - Katie comes home to Scotland.

11-04-2005 - Filed I-130 DCF London Embassy

14-04-2005 - DCF rejected. Must file through a US SC.

02-06-2005 - Filed I-130 TSC

13-06-2005 - Receipt notice from CSC

28-12-2005 - Received email notification, I-130 approved 21-12-05!!

09-01-2006 - Case received by NVC, case number assigned.

15-11-2006 - NVC complete case and forward to Embassy in London.

19-01-2007 - Interview scheduled for Feb 28th.

06-02-2007 - Medical in London

28-02-2007 - Visa Interview - APPROVED!!!

02-03-2007 - Visa in hand.

23-05-2007 - Enter USA through Newark (EWR)
