Fiance will process K1 visa,should I process our 4month old kid the K2 visa?

Hello all, I really need your thoughts on this. My fiance is about to file a K1 petition, I would like to ask if we need to include our 4 month old kid to the I-129 form to be processed for the K2 visa, tho I read online as well that we can also just request for a special passport for her since her dad is a US citizen and he acknowledged our kid on her birth certificate. I really really need your help. we're about to file the petition this week.

Your child was born to a US citizen parent and acquired citizenship at birth so apply for CRBA and US Passport in US Embassy Manila for your child. Once approved both CRBA and US Passport will be delivered to your home after a month.

Are you applying for K1 Fiance Visa or K3 Visa? You can start both at same time if you want, when we applied for my son's CBRA it took us like 2 months to gather all the required documents for the interview. Will the father of your child attend the interview at US Embassy? if not then he will have to send all notarized copies of the required evidence and filled out forms to you.

K3 is practically obsolete, so forget that.

Your fiance visa petition and your son's CRBA are separate applications. They can be filed in parallel or one can be filed after the other. However, just be mindful that a K1 visa application may take 6 months to a year. So might be a good idea to get a headstart on this.

Being your fiance, USC, is the father you will not include the child on the I-129F as he is already a USC, you need to complete CRBA and get him a U.S. passport. Do delay with this as it can take a few months to get this done.

You will simply not apply for a visa for them later when you apply for your K-1.

FORM I-129F:NOTE: IF THE CHILDREN OF YOUR FIANCE ARE ALSO YOUR CHILDREN THEY MIGHT HAVE ACQUIRED CITIZENSHIP THROUGH YOU. CHECK TRAVELSTATE.GOV For Information.

It was also said on the site that I would only need to include the children on the form if I want to petition them in the states and adjust their status, but since I don't need to adjust the status of our kid since she's acquired the citizenship of my fiance, I believe I don't need to include her on the form.

I believe, without looking at the form, there are two spots to list children. One states to list all children and one states to list children who will accompany or follow-to-join. Read the instructions carefully. You have to list the children, even his, where it says to list all children. Also you need to be clear which process you are following. Are you a fiancé or a spouse. It is different forms and procedures depending on if you are married or just engaged.

No I am not wrong, if the children are USC they do not need to be listed on the I-129F, only foreign children of the beneficiary need be listed, as this is a petition for a visa and USC are not eligible for a visa to the USA.

No it is not visa fraud to not list USC children on the I-129F (after all they are not elgible for a visa ;) ), in fact not listing foreign children on the I-129F only means they will NOT be eligible to apply for a visa once the petition is approved.

The I-129F is a PETITION by the peitioner (USC) for the foreign beneficiary/beneficiaries to be allowed to apply for a visa.

You will need to complete CRBA and get a U.S. passport for the child.

You will list the child on the DS-160 in the section about who will be traveling with you.
