Stopping a I-130 petition for relative made by estranged spouse

Hello all.

If a couple are in the midst of a divorce, can the green card holding spouse (conditions lifted) still file a I-130 for an adult child? (not yet 21) when the US citizen spouse rejects the idea, and just found out about it? Can it be stopped? Any info would be greatly appreciated.

You can file the petition but as an LPR you have a couple of years to wait for a visa number. Do you make enough to sponsor on your own or have a joint one ?

If they are getting divorced, why does it matter if the LPR files for her child?

The LPR can file whatever he/she wants. It has nothing to do with the spouse.

There is nothing the USC spouse can do about a petition that he/she has no part of.

LPR = legal permanent resident = green card holder

There is nothing you can do. You are not a part of a petition filed by another person for someone else.

Her bringing her child to the US has nothing to do with you.
