Which last name to use on applicaion?

Hi there,

I'm new to the site and, after going through everything, now I'm almost done filling an application to adjust my status (I'm from overseas and just married here in the US). There's one thing I'm not quite sure is my last name of the application.

I've decided to take my husband's last name as my new last name at the city hall marriage ceremony, though my passport is still under my maiden name. The question is which last name do I use to put on all applications to adjust my status?

PS we talked a few attorney and they all want over $2000 to do this and I'm very happy that we can actually do it myself, especially after reading info from this site!

Whichever name you want on your green card and are going to use from now on should be the name you use on the forms.

Ensure you include your maiden name under the "Other names used" sections of any forms which contain it.

Just remember that if you want the green card to eventually be in your married name, you should change your passport to reflect your married name. Visa in passport name, green card in visa name.

My wife used her maiden as a middle name and mine as her last. Her passport still shows her maiden name and she has had no issues with international travel. She does have a US DL in her married name along with her

Social Security card. We applied using her maiden name and asked the IO to change it at the time of the AOS interview for the green card with no issues.

Thanks Bigdog. Can I just put my last name as a middle name? We don't have a middle name where I came from. I'm planning to keep my passport as the same so will have no issues while traveling.

It's fine. It's what I did too. Just make sure you fill-out all the AOS forms consistently (and the EAD and AP forms, if you're planning to apply) in your new married name.

p.s. Keep in mind when travelling internationally (in the future) using a passport in maiden name, you should always bring your marriage cert with you to bridge the last name difference. This is until you have a new passport in your married name.

Awesome! I just need to redo all of my forms but better fix it now than after I filed. Already had my marriage cert copied today for a doctor appoinment! Thank you:)
