Hi everyone!!!

So I always come to the experts here at visajourney, and have come again to ask about something completely different!!

So, my brother in law entered the country illegally in 2004. He was caught while entering the country, and was detained and sent to a facility for a couple of months. He was still a minor when he entered, but turned 18 while in custody. He was given a deportation order with no time frame. I have it in my posession and it just says he needed to leave, time spots are empty. He was not deported out of the country tho, and was handed over to his brother (who is now my husband and who just got his permanant residency!! whoa who!!! ?). My brother in law decided to stay, but used a different name to find work because he thought he would get deported if he used his actual name. He never committed a crime. He left voluntarily to Guatemala in 2012 and recently got married in 2014. He is now a successfull small business owner, and received a Mexican visa, which he plans to use for this coming Octuber.

So we wanted to know what would be the best route for him to take in regards to his coming back legally to the US. How long should he wait?? Can he use the waiver from Guatemala??

He could apply for a visitor visa and hope for a waiver, sounds a long shot.

Agree with Hypnos, it may be time for your relative to start saving his money, and then hire an experienced immigration lawyer. :thumbs:

To everyone being ignorant,

MY BROTHER IN LAW, is part of my family. First time EVER I have encountered such disrespect in this forum. WOOOOWW!!! People come for support here, not criticism. HOW DARE YOU!! Why don't you ask first before passing judgement, and then you would learn that he used his OWN middle name and second last name. No one's identity was stolen here. You guys are a bunch of horrible people with sour lives who have no place here. His deportation order was not enforced. It was more of a formality than anything else. He was allowed to stay and not told when he needed to leave.

I have seen many people who have come for help ganged up on by ignorance and stupidity. This forum helped me so much when I was doing my husband's paper work. Not one disrespectful comment. Now, I am seeing this behavior waaaaaaay to much here. NOT OK. Eventually people will move to another site to get the help, suppport, both emotional and legal, that they need.

Why do this? Why hurt someone else who is only looking for ways to do what they have to do??? Most people come here at 18 and do stupid things. Most americans, born and raised here, from different cultures and backgrounds, also do stupid things and later have to pay for it. Yes, yes, yes, yes, yes we all know this. So, no, people don't come on here to behave as substitute parents to scold and tell people off. SUPPORT SUPPORT SUPPORT. Opinions are great,but we do NOT come here to hear your OPINION.

Its not about being sympathetic, hello!! This place is supposed to be a help for immigration, not a place to begin a discussion. If you noticed my original post, I was sure of the wonderful guidance I would receive here, as I have always received. I am appalled by the bias here. Not expected at all, on top of that, none here know me but feel the right to disrespect a member of my family, thus disrespecting me. My brother in law is a wonderful man who made the mistake to come to this country at 17 years old. Almost dieing on the way here, traumitized by custody who beat him and starved him. He was only 108 pounds when he was released. But that was part of the consequence of his actions. He now has eye disease because of the stress of being in constant fear ruptured veins in his eyes. He recently had eye surgery to save his eyes. So, please stop thinking that all details are before you. That everything is on the table for you to see. He paid a very high price for coming. He also developed a disorder in his nervous system. He has become a young man who has many health issues. Use his story as a warning to others not to come the way he did. That is why he is looking to see how he can come back the right way. He would never come again the way he did.

If he wants to immigrate then any bans are likely to be expired well before he has a current visa number.

Visit, he has a thriving bakery business in Guatemala and his wife is very attached to her family. She would never leave Guatemala to live anywhere else.

Thank, but no need to calm down. I was simple explaining the finer details. Obsviously a CO is not going to care about those points. I was addressing the people who thought it was ok to pass judgement without asking the right questions firts. I already received excellent advice. His point is to visit, not to stay.

Thank you for your wonderful response. I thought this too. And since I am here, I ahve another question. My husband is a recent us resident, from feb, and I am a US citizen. He wanted to see if we can bring his mother here. How would we go about doing that? She is about 56 and has never worked. She has a farm and animals she tends, so she probably won't want to come for a long time, but we wanted to see if through her we can bring my husband's other brothers and sisters. Any advice?
